The shop DROPPED my truck

    No, I don’t think you understand. Act of god is act of god. Where the vehicle was when the earthquake hit doesn’t matter. The shop has 0 fault if an earthquake smashes cars in their shop. No one is at fault and therefore the owners insurance has to cover it.

    Now if the the quake was big enough and the building crumbled to shit and crushed the truck after it fell off the lift.... then it may be covered under their insurance.

    OK Update. I'm at the airport heading to Italy for a few weeks but when I get back my new 2019 TRD Off-road will be waiting for me.

    1. We went with the You break it you Buy it policy.
    - Which mind you is nothing special. They're just buying my truck pre-damage value and a bit more given what my truck was worth.
    2. Then I told them that they should be making NOTHING off of me by selling a new truck. In fact not only At Cost prices but it should hurt a little.
    3. So basically so I don't have years of rebuilding I'm doing the suspension lift, 33s, tint, 125k warranty...
    4. They're actually gonna move my heavy storage drawers system and shell while gone.
    5. Then i'll move over sliders, armor, prinsu rack and swap the dual battery.
    6. Anything else worth getting if it was "at cost" which doesn't necessarily mean cheap... just cheaper.


    I know some of you wouldn't feel totally satisfied with this. But the you break it you buy it thing is a solid way to think about it.
    Sadly if you escalate the situation a lot the issue is they have much more expensive lawyers and I do have a life to live, preferably with a vehicle.

    On a happier note
    I am getting an off-road instead of a sport which i've always regretted.
    And since i am a photographer I'm really happy it's not Black this time. Silver. (not quite as good as blue or red... but I think it'll be ok with the black shell)

    Anyway i'm guessing there are opinions on this. And I'm guessing it's NOT what half of you would have done.

    You'll miss the scoop but otherwise you did good. That said I'd wait until the work is finished before you go out for beers, these guys have butter fingers after all.

    I will miss the scoop for pictures.... however I do enough offroading that it will make life a bit easier. There are times I wish i had a bit better visual.

    I get that. The Act of God in this hypothetical scenario, the earthquake, would unfortunately be on vehicle owner's insurance. Unless you could somehow prove that during the earthquake they decided to put your car on a lift and then it was dropped due to their negligence or stupidity. Most often a shop will have a hold harmless agreement which states they are not liable for theft or vandalism or stuff in that nature as well. So like if they have to park your truck outside during an overnight stay and someone lit it on fire. Truck owner is also paying out of pocket.

    Edit* Policies vary depending on level of garage is all I'm trying to say. Always read your service agreements.

    Glad this worked out. It sounds like it went in your favor. You had 97k on the odometer and now you get to start from 0 again. It's the same generation so your parts should fit perfect. If you don't like the black top on the silver truck, you can always paint the top. Sound like you are getting a very fair price so it's a win-win situation. It's just a truck. There are many like it, but this "new" one will be yours. I'm sure you will treat it like a baby for a day or two then it's back to business. Good luck on your adventure to Italy. Your prize will be ready when you get home.

    Those lifts are the worse. We had those in our Honda store. A few times we were short on the foam pads you place under so you can’t position the vehicles right. So on a new crv you hit the bars that protect the gas tank. Also the way those bitten panels are on the crv the same thing kinda happens on the crv. You hear a little crunch but all is well. I always put them right where the jack point is so it hits the metal point but it still causes the plastic to flex a bit. Can’t blame everything on the tech. We work with what we have to work with.
