    I actually sued BMW/Mini of NA over rejection of warranty work due to a modification. This was in 2004. I had an aftermarket cylinder head. They refused recall/warranty work on the wiring harness due to the modifications to the cylinder head.

    The Magnussen Moss act is worthless. One of these days I'll post the whole story. Long story short, the minute you file a M-M lawsuit, your fucking car becomes evidence and the manufacturer requests that the court treat it a such.

    It is not unusual for a MM Act lawsuit to take over a year to get to court. That means the object of your lawsuit can be - by order of the court - set aside as evidence in the trial. This means no driving it.

    In the meantime, the manufacturer keeps asking for delays to the hearing dates.

    Then you get a judge that may be a layman - meaning he or she doesn't understand that swapping a cylinder head is not related to the wiring harness. Your lawyer is then tasked with the awesome burden of explaining all this to an 80 year old judge who just wants to go home and whack off to old Barbara Stanwyck movies.

    In other words, the Act provides you protection only if you have the money, the time and the potential ability to not use your car for an extended period of time. The idea that people have on this forum that you can wave the Act in a dealers face or in Toyotas face and either scare or intimidate them into immediate submission is unrealistic, and unless you have direct experience with the Act, posters are probably better off shutting their fucking mouths about it.

    I actually "won" my lawsuit - as between the manufacturer and dealer I was made whole though settlement. It took a lot of money, and a lot of time to get there and in the end, it wasn't worth it. I would not recommend that path to anyone here.
