That was the other part of the MM Act that needs to be factored into the equation - the disgust you feel and the misplaced anger towards the car.

I loved that car. Twin charged...would absolutely slay cars three to four times the money at the track. After the ahem "settlement" the car became a totem for all my rage and frustration at BMW. So I showed them...

I sold it and bought a Lotus Elise.

Lotus sponsored a track event near me. Then they had a rep on site who wrote down all the VINs of owners who showed up and tracked their cars.

Got to pick and choose the type of company you own. I'm part owner of a heavy highway construction company. Two of my partners don't even own shirts with collars.

Probably the most insightful thread I have ever read on a car forum. There is a ton of info in that post that is very helpful to anyone considering a full blown escalation. Thank you OP for taking the time to detail that process and your experiences.

To note which cars were being raced for denial of warranty claims later. The irony being that manufacturers often sponsored or held the track days, then had someone recording VINs for warranty refusals later.

Subaru was (in)famous for this also.

I didn't know that Subaru was in on it. I know that Mitsubishi had a big blow up over it and their Evo fans when they were searching autocross posting for owners.

Subaru actually gave the owner a free SCCA membership.

Subaru Impreza WRX models will receive a complimentary membership to the SCCA, the leading sanctioning body for professional and club road racing, rally and autocross events in the United States. The partnership also designates Subaru as an "Official Supporter of the SCCA."

In addition to the free membership, 2002 Subaru Impreza WRX owners will receive a special WRX/ SCCA decal to promote their membership and twelve issues of SportsCar magazine, the official publication of the SCCA. Available in mid-March, the 2002 Subaru Impreza WRX models are part of the new Subaru Driving Performance strategy.

    An oldie but a goodie:

    https://autoweek.com/article/car-ne...abuse-or-autocrossing-most-automakers-are-not

    In particular:

For instance, even though Subaru pops for a one-year SCCA membership for every interested WRX buyer, and in its marketing materials appears to encourage owners to enter their cars in autocross events, the company says autocrossing is racing and racing can void warranty coverage. The WRX/SCCA application form says the SCCA"looks forward to helping you fully experience the benefits of owning this car."But the form also includes a disclaimer that Subaru’s warranty excludes "damage or failure resulting from participation in competition or racing events."

"If the damage looks to be racing related, you’re not going to be covered," says Subaru spokeswoman Larkin Hill. "We don’t want to punish the person who goes out once in a while and autocrosses—and that shouldn’t cause any problems with the car anyway. However, autocross is considered competition and the warranty does not cover abusive driving or competition. If you’re out there racing every weekend, you can’t expect us to fund it."

Thanks for the write up, just confirms everything I've always thought would happen with a MM case. Now we need to expand the shut up unless you know to retailers, I recently had a Les Schwab tell me they could lift my truck and not to worry about warranty as the MM would protect me, I told them to pound sand!

Just excellent. It hurts my feeble brain, but then we have heard some interesting warranty denials around these parts for Tacos going off road.

Congrats on the Elise though. Those float around at the top of my car wishlist.

This is about par for the course. The ONLY use for the Magnuson Moss act is getting a check for diminished value after they've repaired your vehicle too many times over major issues. And that implies a willing and shame-feeling manufacturer, which is not most of them. Was arguing with Toyota corporate last year over getting a simple, minor warranty thing approved and funded, and they told me in my face, that if I didn't like their answer, "go ahead and sue us".
