    Things have changed because manufacturers are greedy and people aren't complaining as much as they should. The same people that picket their cell phone company for a 10% increase in their bill will meekly say OK and go away when the adviser tells them their 40K truck was just designed to be a piece of crap and is operating normally.

    Or, don't worry so much about a warranty by letting it determine the use of our vehicle as its only money. I asked my dealer if I could have NO warranty, and get a reduction in purchase price. He said something like......"Oh, your one of those.". :)

    And Toyota's TRD branding stands for "Toyota Racing Development". And they encourage their customers to purchase all kinds of "TRD" accessories at their dealerships:

    They are in a sense "promoting racing development" of their products to their customers.

    Guess we should all debadge anything "TRD" and/or remove all TRD accessories so they don't make any false claims to deny warranties?? Jk

    Well you have can all the TRD bling on your car that you want, as long as it's just used for mall crawling. There better not be a drop of mud on that skidplate or there goes your entire powertrain warranty!

    The marketing department of Toyota (and pretty much any car manufacturer) is not exactly consulting the warranty and service department when they roll out their ad campaigns. And again, I think a person who was denied warranty work on a vehicle might have a very compelling case when presented to a judge or jury at trial...but most people grossly underestimate the difficulty they will have even getting to trial with their case. A "win" for the defense is often not defined by getting totally vindicated in a trial...a win is preventing you from getting to trial in the first place.

    BMW/Mini got popped in 2015 for outright violating the MMWA for years. FTC came down on them with at least one foot...if you read the terms of the settlement, they got off easy for having defrauded people for so long.

    If you read the docs, they were violating the Act in literally every way possible. Over the course of 13 years, Mini had a corporate policy of scaring customers into their parts and service by threatening them with nullifying warranties and their free maintenance.

    This only happens if the system allows it....if the courts circumvent the spirit of the Act, if the Act is wrongly interpreted (or worse) so lazily enforced that manufacturers outright flaunt their violation of it.

    I hate to give our own, uh, legal expert anymore air time, but the fact that he took one of his feet out of his mouth long enough to actually defend the cock rot of a judge that forced non-binding mediation on me has got to be the result of either a bad nights sleep or the onset of antibiotic resistant gonorrhea.

    Again, not only was it not part of the warranty "contract", but that the manufacturer had tried to force BINDING mediation through their warranty agreement - which no one argued was legal...in fact it was pointed out that it expressly violated the verbiage directly contained in the MMWA. The fact that we are actually arguing that a judge is so bone stupid, he'd reward a corporation for breaking federal law amazes me....but what the fuck, this place amazes me every day.

    I'm not exactly following your post. Are you saying I'm the legal expert that you're giving more "air time?" If so, that's a comical statement (and unnecessarily sarcastic)...but I wasn't taking any shots at you to be clear. I also wasn't defending the judge that you so clearly dislike and think is stupid. I was saying that i wasn't going to comment on whether the judge got his rulings right or wrong for PRECISELY the reason you stated in your post...I don't have all of the facts and wasn't there, so I can't reach an informed opinion either way on the intellectual capacity of the judge or his ability to understand and follow the law. The whole bit about not commenting on things you don't know rings true to me.

    What I was saying is that regardless of the facts of a specific case, your point that the M_M Act is just a piece of legislation that can be subject to litigation and not the silver bullet some people think it is, is true. Even if you're 100% right, and they're in violation of the Act, getting to the point where you have "won" your case is an expensive, long and uncertain journey, so relying on it for protection is not without risk. That the risk a person inherently assumes when they modify their vehicle. At some point you may be unfairly denied warranty work and find yourself in an uphill battle to prove that you're right. Not everyone has the stomach for that. So we're saying the same thing there.

    Your first post in this thread was a better statement of the same point I've been making for 10+ years trying to help my car/truck enthusiast bretheren out. Your story is more impactful because you actually fought the battle and can tell the story.
