how would i go about selling a gun?

ive always wondered if there's any special papers or permits i would need to fill out if i were to sell a gun as a private party (legally). just a bill of sale? its hard to trust ppl these days so id want more than just cash and a handshake. i tried looking up GA's laws about it but no such luck. can anyone help?

well im not looking to sell per se. i just aquired an I.N.A .38 special and it got me thinking. i sell 2nd hand stuff alot and just wondering if there was anything special needed if i decided to get rid of the pistol...that being said i will entertain offers on most anything i got

private sale, without any interstate shipping, needs pretty much a receipt as proof. Of course, not really... I too have a .22 on a handshake and a cleared check. If you want to be a bit safer, most FFL's will facilitate a sale from one private party to another.

Anything interstate needs to be shipped from a FFL to a FFL (that's Federal Firearms License, ie gun store, pawn shop, etc. Someone that's allowed to sell firearms and run background checks).

 

I used to live in GA, it should be a 'FTF cash & carry' State. That means nothing special as long as the buyer is a resident of GA. "If" you want it out of your name you could go through an FFL, in state or out of state. That would let the next buyer go through the background check & provide separation between you & the gun. There are also plenty of outdoor forums to list it on(glocktalk,thefiringline, etc).

 

Check your states laws.

 

Make the deal, get paid, wait for the money to clear.

The buyer picks a local FFL and you ship it to that FFL directly. Make sure to include a note with the buyer's name. It's the buyers responsibility to pick an FFL, contact them, and have them send you a copy of their FFL permit. This keeps you in the clear.

Buyer goes to FFL, does paperwork and takes possession of the gun after paying the paperwork fee (typically $20/$25).

Your shipping documents to the FFL should include the gun's serial number and should be traceable/certified/insured. Keep the receipt as proof you are no longer the owner of the gun in case it ends up in the 6 o'clock news heist on the local bank

I don't remember, but you can only use USPS or UPS. One of them will not permit you to ship firearms. Can't remember which one.

Fine print: ianal, never buy a used gun, and never sell a gun without copies of buyer's id and a dated receipt including serial number

Seems like it would be worth having the buyer go with you to a licensed gun dealer and let them handle the paperwork. Can't cost that much, and you have the peace of mind it won't come back to bite you in the ass. Pretty sure it has to be done that way in California.

 

Wow whats the Cal....? I'm in cali and if it's a 270 cal I'd like it and would pay forall payperwork and I'd look up ffl's for you/us pm me if you'd like to make the deal

The answer to your question varies by state, so don't take the word of people in this forum.

I've bought and sold a lot of guns. Shooting is probably my biggest hobby.

I used to be stationed in Georgia, but that was in 2004-2006. I doubt things have changed, but just keep that in mind. When I was there, you could have a FTF (face to face) deal with another GA resident for either a long gun or a handgun. A bill of sale (BOS) is highly recommended, but I don't think it's required. You should make a reasonable effort though to determine that the buyer isn't prohibited from owning a firearm (felon). Personally, I like to ask for a copy of their DL and CCW permit or a copy of a recently approved ATF Form 4473 which they would have filled out had they bought a gun at an FFL. Or you could go to an FFL and have them do the transfer for you if you'd feel more comfortable. They will do a background (NICS) check, but they will most likely charge you $20 or more to do the transfer.

If you sell it to a non-GA resident, you must go through an FFL. Contrary to what someone else said, you do not have to have an FFL ship it for you though. You can ship it to the buyer's FFL directly. However if it's a handgun you'll end up having to ship it overnight UPS or Fedex.

I now a guy that has a cousin in AZ and he told me that his cousin bought him a rifle and packed it in a Gamo pellet gun box and fed-ex'd it to him here on Maui. I thought it was BS but he showed me the gun, I still question the shipment though.

 

You could very well get away with it, but it should have gone to an FFL in Hawaii and been transferred to your friend.

It only costs $20-$40 for a transfer at an FFL. It's not worth the consequences if you get caught breaking that federal law to save a couple bucks.

 

That's the thing he said no FFL, they told fed-ex that it was just a pellet gun, it went straight to his door. The fed-ex lady commented on how heavy the "pellet gun" was.
