Hopefully my dad wins his case. The state tried to take his ag exemption away this year because they couldn't figure out how to access his property. The only way in or out is thru my uncle's property

You are correct, must have a documented right of way. Due to the civil war land grants years ago, there was a tremendous amount of land awarded without out access. But right of ways where a hand shake deal. There is provisions that the court will take into account such as grandfathered right of way. But you still have to got to court over it. Just went through this scenario 2 years ago.
