This reminds me of a question I have always had. Do patchmakers get permission to use other's designs and logos or are they copying IP without permission and hoping no one comes after them? No offense to the patchmakers; I am genuinely curious.

 

I am! I almost immediately regret the post, though (feeling lawyery, might delete later, IDK). But I am thinking there is no way Disney was like, "yeh, use our Toy Story logo." But then someone is like, "hey, don't copy the design that I copied!"

Patches would be $150 instead of $15 if they went to Disney for the rights...just sayin lol

It’s kind of a paradox when you think about it, people copying popular art/company logo for a patch and then other people trying to copy them

From what I've seen, $150-$175 for v1 (especially with card) and roughly $50-$75 for v2.

That sticker is also sold out and I'm not making any more like that (they all now have a black border). So not saying it's worth more than the $3 I think they originally went for but adding them to either of those two early tacos may sweeten the deal...

And if you're looking to sell, I know people looking if you're interested.

I've thought about doing something like this for ages now. I asked on Reddit when I saw folks on Etsy selling NFL t-shirts which used team colors & star player last names. (eg: BRADY & GRONK & EDELMAN & BOLDEN & CHUNG) The general understanding was that as long as you aren't 1) making a notable amount of money, or 2) falsely claiming it's official brand merchandise, then you will most likely fly under the radar... or you get a cease & desist and just pull the art/product

That's what I was led to believe... but this advice could also be a trap set by Father Disney

ALL THAT TO SAY, I'm thinking of making a few patches and seeing how many lawsuits I get. My mom bought some wacky Brother sewing machine which can embroider patches

 

IN MY OPINION as a maker and as a professional commercial designer, all I can say is this:

Don't copy someone else's artwork.

This is not the same as copying logos for existing brands. That happens all the time and a little of what you said is true.
But you're treading a thin line as to what's considered "lazy designing" if you do that vs. being original.

If you create your own art, you have a much better chance at gaining a name for yourself and getting a following that will support your work.

Making bootleg designs that are probably already out there on etsy somewhere makes it easy for people to pass on your work.
Also, you could get in trouble for doing that not from the IP owners but from places like here which don't want to get accused of being a marketplace for knock off products.

Creating pieces that are derivative of existing works or themed after pop culture material is a different animal altogether and generally widely accepted to be "in the grey area" of copyright and trademark law. Disney *could* come after you if you make a Darth Vader themed patch but if there's only 100 ever made it's not worth their efforts legally to do anything about it. They are aware of stuff like that and write it off as "fan inspired art" and more or less promotes their overall brand so they allow it. Mostly.
