Cop made a mistake when he pulled me over!

    Yesterday I was heading home from work. I was going through town when I saw a cop pull behind me. I look down and sure enough I was ab 12 over. 30 mph zone. I pull over before he ever turns his lights on. He comes up tells me what I already know. I hand him my license and insurance. He comes back and says the insurance card is expired. I stuck it back in my wallet and looked for the current. Well I couldn't find it. So I got a speeding ticket and a no proof citation. Today I look at the insurance card I gave him and it wasn't out of date. I guess he looked at the activation date. I want to just pay the ticket and be done with it but now I will have to go to court to show proof. Is there any way I can resolve this without missing work?

    ^ yah x2 from what ive always heard anytime theres a mistake the ticket gets thrown out, a buddy of mine got away with a DUI that way. you should get in contact with the officer and see if he can take care of it by chance so you dont have to bother with goin to court and takin off work.

    Usually even if theres a time on your ticket, you can go anytime before midnight or the court closes on the day that you are due. No you will not be able to convince them over the phone that the cop messed up. Go to court, show your proof of insurance, and it gets dropped anyway. hopefully you can make it there without losing pay.

    I'm going to call the dept tomm. I'm not really worried about getting the ticket thrown out. I mean I wouldn't mind but I don't see it happening. It'd be my word against his anyway. And who's the judge gonna believe? An officer or a 18 year old. I'm okay with paying it. It was my fuck up :eek:. They got me for window tint too :(. I hate to rip it off. It looks so purty

    speeding ticket...bite the bullet

    no proof of insurance...leave a msg with the dept for the officer to call you...it may take 3 or 4 days...explain what happened and see if he'll nol pros the ticket...if he wont go to court and try to get the judge to see it your way (be polite...only speak when its your turn...dress nice...etc etc

    tint...make it legal or bite the bullet

    x2. also, police officers are busy so you may need to call again if he doesn't get in touch within a few days. you will gain credibility by admitting that you were speeding and had tint, but have a problem with the insurance ticket.

    In my experience, if you go to the courthouse and show the judge the proper, up-to-date card, they throw the charge out (especially when the activation date is prior to the "infraction").

    Check your court's hours. They may be open outside of work hours.

    Oh yeah I already knew that they'd throw it out when I took the card. The mistake is just bad because I would prefer just to pay the ticket without going to court. But with the insurance citation I I have to go a present my proof right?

    My dad said to me after the ticket. "why'd you put that tint on if you knee it was too dark?". This is coming from a man with 5^ all the way around on his truck. Lol

    If you have proof of insurance and its valid and not lapsed it will get dropped most likely.

    oil change...
    Ive gotten a ticket for expired insurance before. well i just didnt have the current paper with me. I took the current insuance paper with me when I went to pay, showed the lady at the window and only had to pay the 10 dollar dissmisal fee. same thing happend to expired inspection sticker

    Actually no. It's all on one court date. The 3rd of October is what he wrote on the ticket... Which is a Sunday. That's pretty strange too.

    Personally I'd show up to the court date. You might be able to get the speeding ticket reduced, especially if the cop doesn't show (not sure how common that is where you're from but where I grew up the cops don't show up to court dates and the tickets end up getting reduced to non-moving violations). The cost of the ticket is minimal compared to your insurance hike.

    when i write multiple tickets, the violator gets 3 summons...all of which will have the same court date...unless of course i arrest him for some sort of felony...which...obviously you werent

    There used to be a legit chance but nowadays i think more and more departments are instituting punishment of some sort if officers DONT show up

    To me thats just straight up accountability. If you charge someone with a crime, you should make the effort to show up in court for it.

    Typically though, I think if the prosecuting officer doesnt show up, judges will toss the ticket...


    OP, it NEVER hurts to wait, show up to court, and talk with the officer

    Unless you were a straight out dickhole on the side of the road, there is a possibility that he could reduce your tickets...like say drop 1 in exchange for a guilty plea on another...and the insurance ticket should be dropped regardless

    Maybe tell him youre willing to trade a guilty plea to a lesser speeding charge if he'll drop the tint ticket

    OR show him that you have proper insurance, fix your tint, and hope he'll think you're not an everyday run-of-the-mill knucklehead and lower the speeding ticket

    It may cost you a day of pay, but if you get popped on insurance for your speeding ticket...it could cost you into the 1000s of dollars over the course of time

    I would think you could mail in a copy of the insurance, here you can at least.

    Because there is no way to prove when you printed your proof of insurance, chances are you won't get any thing thrown out. Their defense will be you could have printed it after the fact. Unless you actually get something like a plastic card from the insurance co.
