Someone can't stay in their lane and drifts onto the shoulder 3 times and gets written a $30 ticket for a county ordinance instead of the $2500/1 yr in jail Reckless Driving charge it could have been and you think it is bullshit?

 

Yep, I do! It was a fishing expedition.... But I was being (Sarcastic)

I also think being twice punished for the same crime (ticket) in another State is bullshit as well..

 

How are you punished twice?

 

Got a speeding ticket in GA or will get a plea deal on Wednesday in GA when I go to battle this reducing the the ticket to something other than speeding. Then come to find out you get hammered by VA for the same crime in another State where you paid the fine and I get the “one driver license” concept... But to be hammered twice for the same crime is bullshit!

 

Really? VA fined you for speeding in GA?

 

Yep most of the southern states have shared reciprocation agreements. I had to have my lawyer work my speeding case in VA and NC when I got ticketed in VA few years back when I was moving to the area. DA in NC was nice though

 

You got a ticket in VA and NC made you pay them a fine?

 

I thought the recriprocity agreement was only for points on your driver's license. It's the "kiss and tell" law. I could be very wrong about that though.

 

Not fine...the charge. I was 16 over in VA and in NC that's a reckless. I had to work with both states to get it squared away and reduced. Only paid fine in VA

Yeah ok, that makes sense. That's exactly what the kiss and tell law does. Your 'crime' follows you home.

 

Ok. You were fined in the state you committed the infraction in and the state that issued you your license applied the points to your NC license in accordance with what the points would have been had you committed the same infraction in NC. So you were not punished twice.

 

Well one would argue that is two punishments. But in my case DA NC chose to ignore completely. Had I plead guilty to 16 over, I would have been fined in VA and had my license revoked in NC as it is considered a reckless at 15 over and not 20 over like VA

Not sure how other states would react.

 

Not trying to argue because I don't really care...but if you committed a felony in another state then you'd be a felon in your home state too.

 

True. But some of the traffic infractions are inconsistent so misdemeanor in one state turns you into a felon in another.

 

Why is reckless the alternative? I would say it's BS because he wrote him under the County Ordinance which doesn't really apply as opposed to the State Code of Failure to Maintain Lane which does apply. The Officer wanted the money to go to the County instead of the State. Almost every County in Virginia has incorporated 46.2 into their ordinances as well, so he could have written that County version of the correct charge. But the County's want to brag about how well their legislation is doing.

It's true for other charges as well. One specifically that comes to mind is the varying ages of consent and sex crimes.
