    I will say, though, that the failure to pay full time and attention doesn't carry any points, so if he had absolutely made up his mind he was was going to write him a ticket, which apparently he had, he is doing him a favor by writing the no points ticket, even if it is a product of "legal fiction."

    ETA: I blame the government though. If they would write for, or charge, the actual crime instead of trying to fit a square peg into a round hole, or over-charging, throwing everything at the wall and just seeing what sticks, then lawyers wouldn't be as necessary.

    Well, All I can say I hope the effort I am putting in for this will pay off and this will get reduced to something other than speeding and any thing over 80 MPH. What I am looking for is "79 in a 70" or possibly "To fast for conditions"...

    Never said VA fined me but If I understand the law right VA could suspend my DL maybe Rob could clarify that part?

    Thanks to the driver license compact , your driving record will follow you almost anywhere you go in the United States. The DLC is an interstate agreement that facilitates states' exchange of information regarding traffic violations, suspensions, and revocations. The compact's motto is "One Driver, One License, One Record."

    Under the compact, virtually all traffic offenses that occur in a different state are treated as if they occurred in the state where you're licensed this is limited to moving violations. So, it will likely be suspended in the state to which you reside according to the home states laws. One good thing here is GA is not a member state of the DLC so I am also hoping this gets buried in a pile....

    We'll see what happens 23 OCT @ 0900 on whether or not I am successful in making a deal. I even tried to cut a deal where I would pay the entire fine court costs as long as this was reduced to anything less than speeding or under 80 MPH NOPE nothing.

    I've found a pretty effective loophole for this law that everyone can use. Don't break the traffic law. :poking:

    You said you were being punished twice. I was trying to clarify that. Sure, VA DMV could suspend your OL, but since they don't for a single ticket IN the state, I doubt it. Still would not be punishing you. More of a protecting us kinda thing. But again, the DMV rarely suspends a license based on points. So stay out of Virginia courts and you are fine.

    When I got my speeding ticket+reckless a month later here in VA, I got a very angrily worded letter from the CA DMV. It was like getting a letter from a disappointed, yet angry father. I wish I would have saved it because looking back it was pretty funny.
