That's my daily route. That third lane is a "No Parking Anytime" lane during rush hour.
No matter what though, this is your fault for failing to yield. You're sol here.

I'm confused - it appears OP is in California. It's illegal to operate a vehicle without proof of insurance in California.

This, all day every day. Sorry OP but you have no leg to stand on here. If you pulled into oncoming traffic it does NOT matter how fast she was going, you are 100% at fault.

I also missed the explanation, OP - why didn't/don't you have insurance?

Do insurance companies usually just do the shoulder shrug and say "I guess he got me!" and let people without insurance go scott free? Sure the tesla driver might not ever have to deal with the OP, but will her insurance company?

The tesla drivers insurance company will most likely go after him to recoup their losses.

A back step for when I get older, Carhartt seatcovers, 4Runner wheels, Topper, and "tats all folks"! --for now!!
if there is cam evidence from the Tesla your "goose is cooked" as their cameras record speed as well. Unless you come to an agreement (how much damage to the Tesla?), we have a legal battle brewing here that may cost you and them heavy lawyers fees.
Moral of this --NEVER NEVER trust "courtesy drivers' letting you cross oncoming traffic, because you are still wrong!

From my understanding other insurance will try to be compensated for repairs they’ll have to cover.

TIL that NH doesn't require insurance and as a legal insured motorist living in NH, I immediately beelined to my policy to make sure I have uninsured motorist coverage. So in some ways, the OP is the hero that we didnt' realize we needed.

I said it before and I'll say it again, OP - I would beg the mods here to completely delete this thread. I think you are just digging yourself a deeper hole by posting this.
I would not want to be in your shoes, illegally driving without insurance and then causing a pretty severe accident. WITH A TESLA! That's going to be BIG dollars to fix. Also, good luck getting insurance now. So sad, mainly for the tesla driver.

It’s sad these situations happen, people letting other and the person turning go on a three lane section is just bad news. I watched a similar thing happen and was expecting the person to get hit and of course did. Unless you can see that third lane clearly I would never attempt a turn like this.

it’s nice to be courteous but normally the driver in the third lane has no idea and is going the normal speed limit compared to all the others stopped.

if it seems like the other person doesn't have any assets worth going after then yes, they will go about their merry way. small claims court is very time consuming and lawyer fees will probably end being more than what it would cost to fix their customer's car.
