She’s young so doubt she would take it to a courts martial so in that respect they would have no issue with 134, but if she did fight it. It could easily go either way.

Trust me, the days of command being able to just say it’s illegal are gone. Most unit lawyers will look at it from the perspective of it going to court or soldier getting a lawyer. Some will let it pass but the good ones challenge the command with an actual winning case should it go to court martial.

Keeps the CoC from undermining themselves should it get challenged. Nothing worse then looking like an ass by having an art 15 dropped when the commander tried to initiate it before having the facts.

 

We had two soldiers get a DUI when I was a 1SG, one was an NCO and one was a Joe. We were only able to kick out the NCO because DIV had a policy letter saying that’s what would happen. BDE did too BUT it hadn’t been signed by the new BDE CDR on the date the NCO committed the offense. I know it’s apples and oranges but just shows how it’s viewed a lot of times now.

and that would be immediately refuted by her continued distribution of pornographic content that can identify her (by others) linked to the United States Marine Corps. this would damage the image of the USMC in-total. everything from recruiting to requests for funding from congress and this could be brought up by a concerned mother or senator.

You have a great point about continuing to keep the site with there being general knowledge of her status as a marine. Had that been closed and remained closed, I’d stand 100% by my view point. That right there might be one of the best openings. It changes the whole course of her argument.

 

Gave me a flashback of meetings with the CDR and JAG determining what does it doesn’t meet the standards to proceed. I can proudly say I sent two dirtbags to Leavenworth for a year each. Both were completely separate offenses too.

Fight for the good ones, burn the ones that just bring the unit down.

That’s what one of my Leavenworth guys said before he put a camera in the women’s bathroom stall. Hope it was worth a year of fed prison and felony on your record... oh and lifetime of registering as a sex offender.

 

Theres probably so many courts martial's at every base, from drugs to robbery to rape....prob hundreds across the country. As they say we are just a part of the whole society.

People tend to think military are all good or all bad depending on your stance but in reality a nations military is a direct reflection of the nations society as a whole.

lol I wouldn’t know thank god! I in no way imagine that it’s a country club though. Best part, they go straight from the court martial to holding to prison. All their shit gets boxed by the unit and even car shipped. No ability to make sure your shit is taken care of, you get to wonder if your personal stuff even got boxed ok. Just ONE more thing to have to think about.
