    I’d love it if someone from the bank who holds the title would work with me at all but they won’t tak to me or the police about anything at all. I’d be willing to actually buy it! Anyone have any ideas on who I can call to talk about this with capital one?

    You said you've had it a couple of months right? So the guy who skipped town would theoretically be behind on two of his loan payments? How many payments can someone miss before a bank repo's the rig? Maybe they won't even dive into this until he's behind on the loan enough to initiate their repossession process. I dunno man, this thing is pretty fucky, and I don't think you are going to find an answer here because I doubt anyone has been through the same thing. I hope the bank recognizes that you got screwed too and tries to work something out, but a betting man would put his money on the bank collecting their collateral and moving on. They can just repo the truck and wash their hands of it, but obviously it's harder for you. Sucks dude, good luck.

    The bank probably won't start repossession proceedings until the loan is 90-120 past due. That's when it becomes a target for the repo man.

    OP, you need a lawyer that will be able to have productive conversations with both the police to see what is happening with the fraud case, the lender about what should happen with their asset, and initiate a civil case against the seller. TW can't help you other than memes and bad ideas.

    I dont think he did any actual time other than holding for processing a d maybe a couple of weeks in county. Pretty sure he got probation only, as I think his total take from the bank was $700.00.

    My second question is, who is smart enough to purchase a vehicle with cash (35k) but dumb enough ...

    On what basis would the IRS allow that? I don't recall a bad deal line item on schedule A. And even gambling losses can't exceed your winnings.

    Pretty much true.

    But I still don't believe we know all the story. And may never. But I'm willing to wait a while. 'Cause this is a first.

    I'll bet slightly less then OP paid that it started off simple enough. Naive OP paid cash to a random from the internet that is one of those bogeymen from the stories and the reason VIN checks and notaries are a big part of private sales. Then he realized he'd been duped and called the police. They took his info, said sounds like a civil issue but we'll look into it. Next he called the lender who said "Due to federal privacy laws we can only discuss this loan with named parties." Normal humans (who would have done a bit of homework before a 35k cash purchase) would have called a lawyer as 35k is outside DIY territory but OP did *cough* other things.

    How much cash did you pay for it? There's no way you paid $35k cash and are willing to "actually buy it" again.

    Vin check and inspection were done. All clear. He had just bought it so the title hadn't even been registered with the bank yet ( no lien on vin report) Checked with dealership that truck was bought from in his home state and was reassured he was the purchaser.... like I said we know who he is and so do the cops but it’s a waiting game for me if it’s even possible for his state to try and bring him in( unlikely) and potential of extradition is still on the table but low. We have a lot more information on him that will be helpful once we either pursue civil or criminal Charges... if nothing comes of criminal we will just fly out to where he lives and deal with it that way but I’ve been informed by the cops to stand my ground in the mean time which is getting to be way too much time. Hence TW for maybe a solution we haven’t thought of yet.

    Was done as soon as I got back home. ( couple days after purchase) was told title was real but a picture of it not actual title as another one had been issued after it. By this time burner phone was thrown away and there was no way to contact seller. The bank holds the title but isn’t willing to talk to me about anything.

    Traveling across state lines with the intent to commit a crime is a federal offense, have you provided all the info you have to federal authorities to attack that angle?

    This is why you should pay an attorney, this is literally what they do for a living. Instead of asking random people on the internet, ask a professional.
