Oregon Licensing Delay Notice

    Just recently purchased an 05 Tacoma from a dealership. They said it might take a little while for title/plates, however I received a "Licensing Delay Notice" today in the mail.

    The notice stated that the delay was due to not receiving the title from the previous lien holder.

    Does this mean I am on the hook for the previous loan on the truck? When purchased the dealer said the title was clean and no worries.

    Well, that’s pretty screwy. The dealer sold you a truck that they didn’t have the title for.

    Welds and Cuts and stuff
    The previous loan, if there was one, has nothing to do with you. I’d be asking the dealer how they sold you a truck they didn’t have title to?

    The letter was from the dealer, notifying me of the delay. I guess its a law in Oregon that if there is a delay with DMV stuff, the dealer has to notify you.

    Whats the course of action for a truck with no title? And I thought a loan takeover was common with title transferring?

    Inspect the frame TONIGHT. If there’s rust holes, this title snafu is a blessing. Your truck is too old to qualify for a free Toyota frame replacement. If you find rust holes, take it back to the dealer and tell them to jam it up their ass.

    I gave it a once over before purchase, there was no obvious rust or recent spraying so I went with it. I'll definitely go out in the morning when there is good light to inspect every inch.

    No it's service history is extensive and from the town over from where I purchased it. The carfax says nothing about being sold at auction.

    I know of this happening to my friend less than one year ago with a dealer and a 4Runner. They paid cash though and were out $13k until they paid a lawyer to write a letter. After 7 months of messing around with the dealer themselves the lawyer wrote a letter and within 30 days they returned the 4Runner and got all their cash back.


    Get a lawyer sooner than later.

    Pm me the town this happened in I'll see if it's the same town and dealer.

    It's probably a delay in the DMV transferring the title to the dealer from the previous owner. I wouldn't get worked up yet without more info.

    When I bought my ‘15 two years ago and after signing the paperwork, the dealer told me the paperwork hadn’t cleared from the previous owner (First owner was a 2 year leasee). I was pissed, threatened to walk but stuck it out after renegotiating the price. They explained Toyota was backlogged in processing. Took about a month to clear up.

    I’d consider walking from the deal especially if it has a 4.0. The ‘05s had a head gaskets design that was replaced in ‘06. The old version is more prone to failure.

    Definitely walk of you found holes in your frame.

    For anyone wondering, there is nothing fishy here:
    • Previous owner had a lien on the car (bank has the title)
    • They traded it in to the dealer
    • Dealer paid the bank, but has not received the title.
    • You paid the dealer and took the truck
    • Now the dealer has to wait for the lien free title to come in and THEN submit that title to the DMV in your name
    This happens more frequently than you might expect.

    In fact, I have sold other people cars and bikes that I have not had the title to because they were financed. They pay, you do a bill of sale agreeing to send them the title when you get it, you pay the bank and when the title comes in, you send it to them

    Just got off the phone with the dealer. They say that the former lien holder lost the title, so they’re applying for a duplicate.
    Following the bad news though, they informed me that they never actually put the truck through DEQ. When I purchased it I made sure to ask multiple times about DEQ, and they all said it was done and good to go.

    Guess I’m old school, especially when it comes to dealers. I think it’s fishy practice not to have the title you can sign/assign right there on the spot.

    Haven’t decided yet. I just sold my old car, so I’m SOL if I get rid of the truck.
    Mainly I just am amazed that something so important (DEQ) the Dealer Lied to me about.
