    Just called the Crown Attorney's office and apparently the case has been vacated from court for Dec. 4, 11, and 12.

    Not 100% sure what this means but there was mention of an upcoming case on Jan. 14 and if I was needed I would be issued another subpoena. I wasn't contacted via mail, phone, or in person regarding this so anyone who has a subpoena for Dec. 4, 11, and 12 maybe call for yourself to make sure.

    I was called by Constable Henry and informed of the rescheduling. I followed up with the court officer; Mr. McDonald is being allowed a chance to contact all plaintiffs via email to make restitution. He is then to report his progress at his court apperance on January 14th. Personally I would pass on the restitution to see him convicted of fraud over $5000.-, marched past his wife and children in handcuffs and locked up for 2 years minimum. I'm sure he'll have plenty of company in prisono_O

    380. (1) Everyone who, by deceit, falsehood or other fraudulent means, whether or not it is a false pretense within the meaning of this Act, defrauds the public or any person, whether ascertained or not, of any property, money or valuable security or any service,

    (a) is guilty of an indictable offence and liable to a term of imprisonment not exceeding fourteen years, where the subject-matter of the offence is a testamentary instrument or the value of the subject-matter of the offence exceeds five thousand dollars;"

    It's pretty rare for a first time offender to actually go away to prison for long on fraud charges. All his lawyer has to do is point out he has a family to provide for and that this was really a bad set of business decisions, both of which I get people who were harmed won't agree with but will come up in sentencing if found guilty, and he'll get at best a suspended sentence. For those who don't know a suspended sentence is basically a threat. They let you go on probation and if you violate any of the terms of that probation you go to jail for the length of the suspended sentence.

    If you can get a settlement on restitution with an actual court restitution order I'd go that direction. You might be able to get both, actually, depending on what the crown wants to do. With a restitution order he has to pay you or else you can hire a lawyer to go after his bank accounts, pay cheque, etc. Honestly going that direction will cost you something but "hurt" him and his family more if that's your thing.

    Let's go out on a limb and assume there are a few additional complainants outside of this forum. If his lawyer can successfully argue your proposition; I'll hire him. Another consideration, if it hasn't been pursued already, is contacting the CRA. He collected HST and unreported income with the intent to defraud his clients and the Government of Canada. This could easily be argued due to fiscal evidence, time and quantity of alleged offences. If he has plead guilty with the promise of restitution; so much the better.

    I've followed things here for a while lol. I was pointing out that the system tends to not punish first time offenders with maximum punishments. It is what it is. I definitely don't think Core only made a few bad decisions but that's what his lawyer will try to spin, even a hint of doubt is all he needs to avoid Jail. Hopefully whatever the punishment people will feel some level of satisfaction and be able to move on from it.

    The saga continues. Contacted the Collingwood court office this morning. It seems we are moving on to February 11th 2020 at 0900 for Mr. McDonald to make another appearance. We are allowed to attend and spectate.

    Willing to agree with that assessment...failure to comply with a court order, without reasonable and prior explanation to the crown and they'll haul your ass back in front of a judge.

    His lawyer might also be trying to prove destitution and hoping a different judge will give his client easier terms.

    I have a novel idea, I plan on showing up at his court appearance and finding out for myself. Please contact me via PM to coordinate and perhaps we can share brunch in Collingwood.

    On another front; to those affected by Mr. McDonald's fraud, please contact the Canadian Revenue Agency to report tax fraud. I'm rather certain the funds he stole from us went unreported as did the HST he collected. Some of us may know, the CRA will spend a dollar to retrieve a dime.
