    I don't think it's stolen. I don't think banks report vehicles as stolen because the payments are not coming in.

    All the more reason to proactively tell the bank of OP's claims of storage fees due.

    The letter he sends them should inform them any unauthorized removal of the vehicle will be criminally prosecuted as theft, and taken as acknowledgement of storage fees due.

    He should also stress to the bank that agreement they have with their customer (e.g. right of entering property to reposess) does not apply to him. He is not their customer and has not conceded any rights to them.

    It sounds like the bank is as baffled by this as OP is. He needs to be making good use of their confusion. Businesses who are owed money bluff people all the time and make claims they can't back up. Its time for OP to get his poker face on and start telling that bank how this thing is going to get resolved.

    It might not work, but as long as he doesn't threaten anything criminal, he may as well bluff.

    Sounds like quite the scam. Have you contacted the local authorities where he resides? I know you mentioned DA and interstate so I assume you’ve only contacted your local authorities. Anyways, if you contact his local authorities, they can go forward with fraud charges and maybe you can be placed into the victim fund or gain restitution. I doubt you’ll get fully reimbursed but it is a legitimate path that doesn’t leave you open as being part of the scam.

    I don’t get it, since November of this thread it’s been highly suggested that op see a lawyer and I don’t recall that being mentioned in an action taken.

    Lawyers are crooks, imo, so it may take multiple attempts to find a solid one but still no mention.

    also like to point out no mention of actual price paid. Mentioned the fact it’s a 35k truck but highly doubtful that’s what op paid when that price will get you a new off the lot. So what was the price? how good of a deal makes the sketchy sell/sale tempting for the op to Pursue in the first place. As of now I can only assume it was well below market to make it appealing in the first place

    Just from reading this headache both u and the bank own this vehicle. Did you get the title notarized?

    Also charge bank $500 a day for storage fee. You will get your $ back and they will play ball. @ksJoe (just read ur post, u said it better)

    That's what I thought. Seller buys new truck and runs away. Buyer is stuck with truck and is on the hook for another $35k to bank. Or seller reports stolen and gets truck returned fully paid off by the buyer.

    People act like the bank either won't say we'll cut you a check or just repo it. The people here are nuts $500-$1000 a day for storage fees? That's the quickest way to find yourself embroiled in a lawsuit with someone that has more money and resources. What's the average daily impound fee these days?

    As someone that used to assign repossessions for a financial institution, average daily storage is 20-30 per day. There are set/flat storage fees for transport, release, etc which are usually hundreds of dollars.

    Just a quick search says that Colorado is a max of $30 a day if the vehicle is under 10,000lbs

    I don't know why people keep coming up with outlandish numbers as the basis for a lien. The OP is in bad shape
