I'm surprised your rate went up. Either they actually deemed it 50/50 or 60/40 fault. Or, it might depend what state you are in.

Parking lot accidents often end up 50/50 fault.

Sounds like the insurance companies gave you a precentage of the fault.

Sounds like you need new insurance. Not that I'm a model citizen of this or anything, but ideally you should shop around every year or two to keep em honest.

Technically you are right, but getting that initial estimate does get the ball rolling. Where he gets an "inspection" and where he gets the truck repaired are 2 different things.

I got sideswiped two years ago and they replaced the entire quarter panel and what not and the bill came out close to 6k. I of course shopped around and went with the most reputable shop in town which happens to be the most expensive. So go find your most expensive quote and turn that in. I know yours isn’t as heavily damaged but if they replace the whole panel you should be well over 2k at least.

Correct but say he gets a check cut and then takes it elsewhere that he trusts and they end up charging him more. He is out the difference. My point was more so that insurance companies will try to pull that BS on people because most don't know any better. I just had to go through this with a motorcycle accident I had where their insurance told me to take it to a car body shop that they "approved" of. I told them I was taking it to where I bought the bike from 7 days prior as they are a bike a shop and specialize in motorcycles. They weren't all that happy with me but ended up paying out rather well and I have spent the winter modifying the bike the same way I wanted to regardless of the accident or not.

That is definitely a bummer and I know certain states are more likely to split fault between parties. I once got rear-ended stopped at a red light and cop wrote the lady a ticket. Her insurance “determined” the accident to be something like 30% my fault since I had tinted taillights. Took a few months of fighting to get their adjusters to come out and measure the light output at 250 feet with brakes on to prove the lady should’ve seen my brake lights. Huge pain but insurances love to have you roll over and take it. Fight everything. Also, don’t tint your taillights.

Nope. He would not be out the difference. It's called a supplement. Anything related to the loss has to be paid for by the insurance company.

The amount of bad and flat out wrong advice on this site is absolutely amazing sometimes.

Be careful what you sign when you accept that check though. Fine print often releases them from any additional responsibility.

I tried to stand up to you once. I think I lost 60/40. Haha

What advice was bad? Not to always go to where they tell you? Wrong, sure. I didn't mention supplements.

Some states insurance clauses will still up your rate even if the other party has full 100% responsibility. Ny is one of those states. No-fault state

I did change insurance and they quoted me a higher rate because of the "accident" as well (switching from state farm to geico).

I dont believe so as I was literally sitting at a stop sign waiting to enter the drive through lane and the woman openly admitted to the police officer that she did not turn around to see what was behind her (too fat). I wonder If it has something to do with FL being a no fault state.

I would have to see it in person but if it is what I think I would probably be able to live with it. I have zero doubts, thouhg, that it would be like 2k to fix it right.

I would assume that's an important detail and probably why.

Here's a shot of some body damage to my truck. Ignore the horrendous damage to the door and rocker panel. See that tiny dent on the bottom front of the wheel well? That was enough to replace the whole side panel. Push back on them until they agree.
