I love my son but we see illegal moves in his jujitsu competitions regularly because the kids - 10-12 year olds - get excited or panicked and grab at anything. He’s come home with a few marks from those opponents but the refs and coaches always call out about it. No need to go beat up someone else’s kid over it.

I live in an middle class neighborhood we don’t have an HOA but the city enforces codes so your can’t have a bunch of junk in your yard and what not

I wish my neighbor would build a playhouse that nice. It would probably raise my home value.

scary part is we have just one side to the story and we’re breaking out the torches and pitchforks.

Most stories have at least three sides. His side, Her side, and the Truth somewhere in between.

what's the defense? they sued for $100,000 over a playset because they think it's an eyesore. I mean the lawsuit speaks for itself.
Oh and it's one of the nicest playsets I have seen in a backyard

Most importantly, the homeowner followed HOA process to the letter and received written approval before proceeding. The asshole neighbors obviously got no traction with the HOA board so they went after the family of a terminally ill child. Not seeing where any part of their side of the story can help sway public opinion against them.

Hopefully the judge throws it out before the mob serves its own cold justice.

My comment was generalized and not specifically defending the neighbors who filed the lawsuit. Everything indicates they're just being azzhats, yet a few years ago I sat on the jury for a two week murder trial. It was surprising how much the media coverage differed from the actual evidence and testimony of the trial. Thus my deep resistance to jumping to conclusions based on simple media coverage -- you don't know what other info wasn't presented.

Yet the HOA won't confirm that though? You'd think that'd be a simple statement of fact. They did or they didn't. Odd the HOA confirms the application but won't confirm the approval?

    From the news article:

Hopefully the actual court will get to the facts of the matter and address the suit appropriately.

I'm not too keen on the "court of public opinion" or mob-served-justice given scenarios such as Tawana Brawley, or Richard Jewell, Crystal Mangum, or even "Jackie Coakley".

I agree that the media will certainly spin this as heartless azzhattery regardless of what the actual facts are, because that's what will drive the news cycle and keep people watching/clicking.

With even national media known to doctor information to suit their agenda, I mean, drive their ratings (ABC and George Zimmerman 911 call comes to mind, as well as NBC putting model rocket motors in the gas tanks of GM pickups to make sure they would explode when hit in the side), the real facts can be hard to come by.

That said, initial impressions are that azzhattery is prevalent in this case and I also agree with CaptAmerica that based on what is known there isn't a way for the neighbors to come out as being justified in their actions.

If there is something more to their complaint you would think that they would reveal the basis of it, but they may be bound from speaking by attorneys as well.

I'm not ready to break out the pitchforks and torches just yet, but you can bet the neighbors have probably already gotten a few "opinions" delivered their way.

    Shows how perceptive I am.

My initial impression would be that she preferred the shag carpet over the hardwood flooring.

And that was really the point of my three-sides-to-every-story post -- merely as reminder that we often do not have the full picture even if it seems we do.

I worked for a large company that for a while was unable to keep itself out of the local news. As a member of the leadership I knew all of the what, when, where, who and why of the incidents. So, it was very insightful to read and see the coverage from the local media outlets. I won't call them liars, but conservative and liberal media struggle with telling the whole truth.

Both sides would cut the story short when "their" view point was made. Click bait headlines were the order of the day, something like "Bla bla CEO was seen hugging an underage girl! Details at 10!" The whole truth was the CEO did hug an underage girl, his daughter. My observation was the conservative media outlets were far more guilty of not telling the whole truth than the liberal ones, but it was only matters of degree. Bottom line if you want the whole story you have to watch both sides. If you think Fox or CNN are telling the whole truth I've got a bridge in Brooklyn for sale.

My unpopular but starkly realistic opninion:

The world today is a hard shitty place, full of assholes and people down on their luck.

When you buy a house and sign the papers you agree to the deed restrictions. Rules are rules. I accept that fact that my excuses aren't going to mean shit to anyone, and expect others to have the same outlook.

All HOAs suck, they are the epitome of what our founding fathers called "taxation without representation".
