    On 10/12/10 it will 4 years since I was hit head on by an underage drunk driver. I am still dealing with the pain from the 2 compressed and fractured vertebras, broken tail bone in two places and broken foot plus the loss of my best friend he lived just turned in to an asshole after get got his money. We all make mistakes, it is what we do after making them that makes us better people. I hope ever thing works out for you Jason. But it could have been bad compared to what you got.

    dude in AZ they are way strict. last year i had 3 beers within 5 hours, my last being 2 hours before we left, while drinking water all night. got pulled over, blew .03 (less than half the limit), passed all the tests graciously, and the cop still made us take a taxi home and leave my truck till morning. I understand "zero tollerance" but the law is .08 for a reason.

    Are you going to fight the DWI ticket? With an atty it would be easy to beat. You simply state your BAC went UP after consuming drinks before hitting the road. At the time you were stopped you had a BAC of.079 or lower. If you really passed the SFST (which you did not if you blew into a breathalyzer becasue you were already cuffed and arrested to get to that point) then its an easy win. You dont want a DWI on your record if you were not impaired.

    There are only 3 SFST that are nationally accepted. HGN, Walk and Turn, and One Leg Stand. I doubt you passed them or you would not be arrested. In fact that alone would remove probable casue and make conviction impossible. I am SFST certified.

    Here in Texas DUI is just a status offense (for under 21) but DWI requires a reading of the statutory warning regarding license suspension. Miranda reading is required once a person is even suspected of an offense and you are questioning regarding that offense. So yes, you have to have be Mirandized unless you make a res gesti statement.

    Here in Texas the limit is .01 for CDL so consider yourself lucky.

    FYI, You can get a DUI/DWI on a bicycle. I used to work with a retired police officer in Las Vegas and he told me you can get a DUI riding a skateboard in your backyard.

    That would depend on the state. You cant get that in Texas. You have to be driving (or in control of) a motor vehicle.

    In VA you can get a DUI while on a bike, not to mention a drunk in public.

    They make it so easy for us to drink but impossible for us to get anywhere after drinking! The public transportation here is a joke, it's nearly impossible getting anywhere with out driving. I've pretty much just quit drinking all together even though that is all there is to do out here besides work. :rolleyes:

    A caseworker is usually assigned to after you've been convicted of DUI. You'll see em hopefully once for an assessment to see what type of treatment is needed ie; ASAP or worse. MADD is Mothers against drunk drivers for those who didnt remember that from high school. It's just one meeting with alot of bad/sad stories.

    I was always the life of the party (i thought I was). But quit drinking in 1989 and now I enjoy watching all of the people who think they are the life of the party and the best part is I can tell them the next day what they did............................and take pictures of it.
