    This information is stored in various modules in the system. The ECM, the ABS Module, and others all accessible with the right software. Most vehicles on the road have had varying degrees of this data for well over a decade. I remember reading an article about an accident in the late 1990's in a Jaguar and police were able to determine the car was speeding through the saved data in the vehicle. That was long before GPS and Navigation units.

    For most things the fine print simply covers your "consent" by merely purchasing said device and using it, in fact if you chose to not accept those TOS/T&C it shuts off and you need to take it back.

    So, you gave consent already. When you sign up for Google, you give consent to them. Facebook, nav systems, Windows, Mac OS, iOS.. all of them have this baked into the use of their devices.

    So with your example, you already gave your child consent.. simply by having the child and not returning it once the T&C/TOS was given... I have always found it funny of them asking if you accept or not.. there is not "Not" if you chose no the device just shuts down and does not work.. it is either you accept or you accept.

    Yep, exactly this. Anything and everything you own that connects to the internet in some way is tracking some amount of information about you. And with every single one of those things, you've explicitly or implicitly given your consent for them to do it, because of a line of text in sale agreement somewhere with your name on it, or because you hurriedly clicked "I Agree" on a ToS page that was four hundred pages of intentionally-dense language that you didn't feel like reading. And as you say, if you hadn't agreed, the company wouldn't allow the service/device/etc to work for you. If you don't want to be tracked, stop using the internet, stop watching TV, stop using a phone, stop driving any vehicle made in the last decade, etc.

    I'm not saying any of this tracking is good, nor am I excusing Toyota for collecting the data. I'm not making a value judgement one way or the other. My point is simply that everything you touch with wifi or broadband capability is probably tracking something about you, and whether you realize it or not, you gave them permission to do so.

    The worst part? You'd be shocked at how bad most companies are at protecting the data they collect about you: especially from IoT devices (i.e. things that aren't phones or computers: smart appliances, cars, home cameras, Alexas, etc). For whatever its worth, from what little I know about them, Toyota is actually one of the better companies in that regard.

    Truth. That's why you take precautions, as I alluded to. Putting a camera in your 8 year old daughter's bedroom is just fuckin dumb no matter how you slice it (referencing recent news). Granted, that's usually a case of weak passwords on the user's part, but Amazon isn't sorting through the thousands of customers trying to find the juiciest footage.

    I use Nest myself, but with zero interior cameras. If you DO need interior surveillance, you should use a closed-loop system. Anything that is Internet-facing is at a non-zero chance of risk.

    As it is, there's not a hell of a lot Toyota can do nefariously with the data they collect. No more than any smartphone you carry on a daily basis as it is. But the chicken-littleness over the dystopian future scares always gives me a laugh. See the autonomous driving thread for some real tin-foil hat shit.

    IoT devices are really bad about this.. reports about privacy leaks are always in the news... *cough Amazon's Ring cough* (all of it, it has a massive security flaw that allows others to access it pretty darn easy AND Amazon itself has also had very bad privacy handling internal with allowing normal employees to view video/audio from said devices.

    Maybe they aren’t worried about Amazon and the other things because it won’t be linked to driving insurance.
    Also if your gps co ordinates are recorded when your check engine light goes on it’s going to be hard to say you had a problem in the parking lot.
