hopefully everyone here is doing well and getting ready to get back on track after all this virus craziness.
Oh man, apologize in advance for the story just trying to assess what ya'll would do in my situation?
brief history--Currently own 2019 TRD Pro in Blue. Stock except for 2nd set of off road wheels and tires, bed lighting, color change ditch lights, extensive vinyl letters/logo as this is my 'work truck'. This is my 3rd tacoma, I still own 2009 X-Runner (165,000miles). When I saw this truck I just HAD to have it. But I didn't want to spend the $58000 for it. So i waited; Patience paid off and I purchased pre-owned with 900 miles on it out of state, we flew to alabama and drove my dream truck back home(reside in houston) late February 2019. I was so excited and quickly fell in LOVE with this truck and got used to driving a 4x4- (coming from an X-runner with 20" wheels and street tires.)
I detail cars all over the USA and put crazy miles on my work vehicles. So by december 23,2019 I had about 34,000 miles on the clock.
This is where I need guidance... Stopped in at circle K in tallahassee to fill up for my return trip to houston. It was 6am, heavy rain and when I pumped gas it was dispensing really slow, crazy slow. It took 22 minutes to pump 5 gallons of gas! MY FAULT...I had run the truck low and could not travel any further without some gas.(this was the only station open sunday morning this early) After the slow gas pump I got on I10 towards houston. There was a huge curved entryway to interstate and my truck seemed to hesitate and jerk a little bit and I felt that because I had run the gas at such a low level before my gas stop; that I had caused something and that maybe it would just 'right' itself as soon as the road leveled. My way of performing mechanics on the side of the road is just turning up the radio and hitting the gas pedal. After a couple of miles or so the dashboard lights went off and the truck lost power. I was driving 80mph and quickly the truck reduced speed to only 35mph. I was so frustrated but being the sunday before christmas at 640am it was a strange predicament. I felt that somehow I had pumped in some bad gas. I woke some car builder friends and they instructed me to get some treatments and run the truck on premium unleaded. I did and made it to Houston. I drove into my subdivision and the truck hesitated a little- not as bad but just didn't feel 'right'. I felt that i had just put it through its paces on 11 hour road trip and just possibly had some bad gas residue in there. So I parked it without driving it.
I called circle k and they had their insurance call me. After getting a hold of their adjuster; he went to the dealership to look at my truck and says he can't find any water in my gas (jan 13 or so) I said --I NEVER SAID I HAD WATER IN MY GAS--I said I had bad gas. Anyways they denied the claim. The dealership called me and said there was no sign of bad gas and I told em to change oil and rotate tires and I would be in to get my truck.
The next day Jan 15 or so I'm going in to pick up my truck and advisor calls me and says the truck has a recall for the fuel pump but they don't have a 'remedy' for it. I say i just need a vehicle to drive. That whole drama would be a whole other post. But the local dealership ended up getting me a 4cyl/ 4dr tacoma.
As of April 23rd this truck will be 4 months with fuel problems, in dealership possession for 3 months, and now they say they have a brake master cylinder recall.
I don't see where it's an actual candidate for 'lemon law'. I reside in Texas and the truck was purchased in Alabama which adds to my woes.
I have called the local houston toyota dealership many times. It just ends up in me getting upset. And they 'hide' behind TOYOTA not having a specific remedy.
I hate making payments on something I cannot enjoy and certainly do not have any confidence this truck that this truck will perform 100%. Many times I drive at all hours of the night and through many different states. My whole idea of getting a new truck was that I could just get in and drive and not have to worry about any mechanical issues arising.
    Any thoughts?

It is not eligible for Lemon Law, but does need to be fixed under warranty.

Your truck is waiting on parts, correct?
