    I'm not up to doing much right now because I was in an accident in my 2002 Toyota Tacoma 4wd pick up truck. I'm wondering if anyone has experienced airbags not deploying in a pretty bad accident. The other car was a Tesla & they said ALL of their airbags had deployed. Even ones by their ankles. I'm pretty messed up & wondered if I should file a suit. Nothing broken but pretty smashed.

    Sorry to see. Those early-generation airbags are pretty powerful. A deploying airbag can actually cause more injury than you experienced, with bleeding in the eye, etc.

    If you sue, burden would be on you to show:
    a) the impact forces exceeded the trigger threshold for your Tacoma's airbag system
    b) your injuries would've been less severe had the airbag deployed
    c) your airbag light wasn't on (i.e. system had no indicated faults) before the crash
    Get 2-3 opinions from lawyers before you proceed.

    Wow. Hope you feel better soon. That sux for sure. I was almost killed in my previous Tacoma last year in September.

    If you feel your safety equipment failed then absolutely get a lawyer. Make sure it occurs before anyone puts hands on your truck though. You don't want anyone tampering.

    Also, if you bought the truck new and did any or had any modifications done, be sure you have documentation.

    Ouch. A big factor is the level of sophistication in a modern Tesla's airbag system versus a basic light truck from 2002. Its not uncommon for older vehicles to not deploy airbags in an accident while modern cars will make the interior a marshmallow.

    The direction of contact as well as speed factor into this. If you were hit from behind the airbag wouldn't deploy as readily as a head-on collision would deploy the airbag.

    Also asking for a poll and not giving us the full story on what happened means that we would be making a pretty uninformed decision.

    As others have said, you'd be better off talking to a lawyer. If you don't have a case they won't take it to court.

    There’s way to many factors that you haven’t shared that would need to be examined. However I like most people here are far from legal experts. So you really should see some professional opinions and advice.

    But here’s some things to look into or need to be presented:

    where was your truck impacted or where did you impact them?

    At what speed was the impact?

    before the impact did you have any SRS lights or electrical issues?

    is there any photographic or video evidence of this accident?

    There are so many more questions and things that really need examined to determine if there was any type of failure that could warrant a lawsuit.

    You also have to remember you’re driving a 18 year old truck that some of or all of it’s safety equipment was designed almost a decade before hand. The Tesla is much more modern with a lot more safety equipment and design.
