Insurance question

    My wife was involved in a 3 car accident in July. She hit someone in the back and someone hit her in the back. We had $4600 of damage and a $500 deductible. We paid the deductible and were on our way. I got a check and a letter yesterday from Allstate that they have resolved everything with the other insurance company and have refunded our $500 back. Is this normal? This was both our first accident so I am unsure how all this works.

    Yes.... normal.

    If you're not at fault..... then you are entitled to full repairs at no cost.

    What happens - you will make arrangements with YOUR insurance company to have everything fixed. This may include paying the deductible. Get you fixed and back on the road without having to wait for the red tape (so to speak).

    In the meantime, your insurance company is communicating with the OTHER (AT FAULT) insurance company and if both parties are in agreement of whom was at fault...... the AT FAULT insurance company will pay YOUR insurance company. Sometimes this red tape can take a while. But as soon as all the crap is ironed out, and your insurance company is paid - that's when you will see a refund of your deductible.

    Did the person your wife HIT claim any damages?? Cause it sounds like you mighta gotten lucky if they did...if they did not that all your company knows is that you were hit I'd guess.

    ::not really sure that it's normal:: I would keep your paperwork at hand and what not...

    Depends on the situation and where it occured.

    I was in a pretty serious multiple car pile up back in 03. Some jackass stopped right in the middle of a highway because of road rage. Ultimately....He was AT FAULT. But by the time the accident had occured (maybe 1/2 mile down the road as traffic backed up), that guy was long gone and didn't even realize he started it.

    Unfortunately, some guy with a big truck & trailer didn't stop in time and started the chain reaction of rear-ending. I was probably 5th car in front of where the first rear-end occured. I got whacked hard as a chain reaction of crap behind me. The guy with the truck & trailer got the blame for ALL of it.
    Apparently, it was a case of..... "All these other vehicles were able to stop, but he was the first one that couldn't and/or didn't"

    Wait? How was it not your Wife's fault? If She rear-ended someone, wouldn't She be at fault? And then the person who hit Her in the back, would be at fault for hitting Her in the back?

    It depends on the situation.

    If someone is illegally stopped on a roadway (or other illegal act) and you rear end them....it can often be THEIR FAULT.

    In the OP's case....a chain reaction occured. Obviously, it wasn't her fault and he got a refund for his deductable.

    I think you would have a very hard time proving they were illegally stopped unless it was an obvious case of road rage or intoxication. You are supposed to be in control of your vehicle at all times, including being aware of what is ahead of you and avoiding it.

    Even stopped and getting rear ended into someone else can give the insurance companies heartburn.

    That's why when you have an accident, you almost ALWAYS call the police.

    A police report is a vital tool for insurance companies to use to make decisions about who's at fault. And when insurance companies can't agree on who's at fault - it goes into Aribitration. Arbitration is when a separate insurance company (who's not involved) comes in an makes the decision of who's at fault.

    And again, obviously.....in this situation...the Op was not at fault.

    Maybe I'm misreading...but how is the OPs wife not at fault??
    sounds like her accident and short stop caused the person behind her to hit her.

    I don't think you can say for fact that she's not at fault cause they got their money back...People get acquitted of crimes they are guilty of all the time. (Not saying that the OP or his wife has committed a crime....but rather that mistakes get made on a regular basis.)

    I wouldn't call the company about it...but I would make sure to keep some money available if they come back lookin for it again.

    I've been in enough fender benders & car accidents to know.... and as I mentioned earlier... He paid the deductable up front to get things fixed. It's obvious that the insurance companies worked things out (or there was a police report involved) to render his insurance company being paid by another insurance company who was 'at fault'. Thus....why he got his refund.

    If it was the OPS fault, he would never see a refund. In fact....some insurance companies will also raise your rates if you're at fault.

    Funny thing- My mother works in insurance and agrees...The way the OPs story is written...He's lucky that he got a refund. His wife hit someone and then someone hit her. At least 1/2 of that accident is almost no questions asked her fault.

    Like I said before...There are VERY few times that a rear end accident is blamed, even in part, on the person in front.

    So either the person in the front did not make a claim and the OP lucked out in a HUGE way because the part of the accident his wife was responsible for got covered by the other guys company. Or the order of the impacts was "She got hit and slid into the person in front of her." Or someone at the insurance company straight up made a mistake. I realize that a fair portion of this is based on semantics...but words matter.

    Allstate also has a policy of no deductable if you hit another Allstate driver. Neither vehicle will pay a deductable if they both carry Allstate policies, regardless of fault.

    I totally understand that and have been in those situations also.

    But some situations are different and especially where multiple cars are involved. The insurance companies & the police report make those decisons.

    What happened is that an 86 year old woman was driving an Oldsmobile and my wife was behind her. She was going under the speed limit according to my wife and the driver behind my wife, so of course no one was driving far back. All of a sudden, the old lady slams her brakes to turn into the bank and my wife nails her and the lady behind my wife nails her. My wife didn't get out of her car until I got there (we live less than a mile from where the accident occurred) When I asked the lady behind my wife what happened, she said the old lady slammed on her brakes and no one could stop in time.

    I know my wife was at fault, but at 86 years old, I am pretty sure the elderly lady just forgot where she was going.

    Well, regardless of who's fault it was or wasn't. This is a good reminder to everyone to try to keep a safe distance from the person in front of you. You just never know if they will slam on the brakes.
