22.07: Mounting and Display of Other Aftermarket Lighting No person shall mount or display any lighting device which does not comply with Federal Motor Vehicle Safety Standards at 49 CFR Part 571, unless specifically allowed by M.G.L. c. 90, § 7. Such prohibited devices shall include, but not be limited to, neon undercarriage lighting.

That will be hard to fight as 49 CFR Part 571 doesn't set specific standards for fog lights. I'd start with the fact that they are sold as SAE compliant lights and are marked as such on the lens.

Thanks for the advice. I mentioned that they were sae compliant but was still told they were not legal. I’ve had them for atleast 8 months now no issues since now.

I'd email Baja Designs customer service stating you got a ticket and need information from them about the SAE compliance of the lights you have. The stuff on the website doesn't go into detail.

I'd go in for the inspection with that info and be respectful. Let them know that you were under the impression that SAE compliance would make them suitable for use on a vehicle operated in MA. Hopefully they accept that and let you keep it. If they say it's good ask for it in writing so you don't have to deal with this situation again. If not be prepared to remove them on the spot.

SAE might be an ok argument, because it shows it is (or should be) a quality lighting product. They might give you trouble because it's not DOT certified though.

Tough one b/c the statute isn't very specific. I agree with hitting up Baja. See if they are DOT approved as @replica9000 said and if so get that in writing also.

DOT doesn't approve or disapprove lights. Manufacturers self certify that they are built to standards.

Regardless of who does the actual testing, lighting needs to comply with DOT standards to be street legal. SAE certification alone isn't enough. A letter from any company proving certification would certainly help.

I'm not sure how much weight having SAE and DOT marked into the light itself will carry, because too many cheap aftermarket companies have copied the mold of an original light as a base for their modifications.

DOT standards for fog lights do not exist, therefore the SAE J583 certification is used as a stand in. And a marking from a large company with years of history carries a lot more weight than one from a generic light from ali baba. Domestic companies are much more worried about violating trade standards and falsely representing their products than an importer than sell lights on ebay or instagram.

Kinda off topic, but is it true that you can't run fogs in MA if it is not inclement weather?

My uncle got pulled over a while back on 91 in MA and the statie said it was because he had his fog lights on when the weather wasn't bad. Stock fogs on a Corolla S.

Is there any validity to this? Or was the cop just trying to find a reason to pull over a VT plated car?

I got pulled over in a loud subie for fogs in clear weather a few years ago. Statie on 91 at 4am. Pretty sure they we looking for reasons to check out drivers. See plenty of cars everyday with fogs on all the time.

Thats what I thought. My fiance's car turns the fogs on automatically with the low beams, and you cant be cited for OEM features so I'm leaning towards the cops looking for an excuse.

In VA, I passed with 3rd brake light blocked, my tires rub in reverse, and I have Baja Designs Squadron Sport as my DRL (anytime fog light mod, and not SAE or whatever..) Also I have bumper and roof light bars, but not on all the time. Oh and I have a LED light bar that faces backwards for when people are tailgating me :anonymous:

I got mine installed 2013 and had my buddy do the anytime mod, so they can be powered on with the running lights. I leave my running lights on all the time. Never been spoken to yet..stock fogs and bulbs.

Now the bar with the PIAA lights.....that's another story.

While reading other forums on my issue I ran into a few people saying they were ticketed for use of fogs in “non inclement” weather. Although think it’s far and few between and cops just looking for a reason to make a traffic stop.
