A 38-year-old California man was arrested for assault after an altercation with another driver on a high-country mountain pass in the San Juan Mountains over who had the right of way.

Ouray County Undersheriff Tammy Stroup said a man identified as Sammy Spaccamonti, of San Diego, was driving a Jeep Rubicon downhill on the Ouray side of Imogene Pass on Saturday when he encountered a car driving uphill.

The passenger in the Toyota Tacoma going uphill, a 42-year-old man from Montrose, got out of the car and was going to ask Spaccamonti to move when a verbal altercation occurred.

Stroup said according to backcountry travel etiquette, vehicles traveling uphill have the right of way.

Spaccamonti allegedly got out of his Jeep, and punched the man, causing him to lose consciousness.

The incident was first reported by the Ouray County Plaindealer.

The victim eventually made it back to town and notified authorities of the alleged assault. He was taken to Montrose Memorial Hospital, Stroup said.

A Ouray County Sheriff’s Office deputy walked the town’s Main Street attempting to locate Spaccamonti, who was found at a local brewery and taken into custody without incident.

Stroup said Spaccamonti was taken to the Montrose County Jail on a $2,500 bail. He is scheduled to appear Aug. 27 for a court hearing.

There's no established ROW. And I'd argue the one going downhill would have ROW so as not to have to backup UP hill.
We could argue this all day. Punching a dude seems excessive. But I wasn't there.:anonymous:

I’ve always been taught that backing up downhill offroad is significantly more dangerous than backing up uphill... of course there are always exceptions to the rule.

"On narrow mountain highways with turnouts having a grade of six percent or more, ascending vehicles shall have the right-of-way over descending vehicles, except where it is more practicable for the ascending vehicle to return to a turnout.” Colo. Rev. Stat. § 42-4-711(2).

Per Colo. Rev. Stat. § 42-1-102: (43) "Highway" means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel or the entire width of every way declared to be a public highway by any law of this state.

What I'm not clear on, and haven't dug into, is if the route/road/trail/track (or any for that matter) that this incident falls under this C.R.S and the definition of "highway".

Nothing to argue about, it has always been uphill due to momentum requirements, etc.

That being said, I have allowed downhill Vehicle, depending on the situation, to proceed.

These days you have a high degree of situational awareness because you never know what the other guy is going to do.

Uphill ROW is written on all official BLM and USFS maps. It is upheld in court in Colorado and pre-dates 4wd which might help explain its existence.

Yeah, I'm a volunteer San Juan Ranger now that I'm retired. It's forcing me to total avoidance of several routes, or quick trips in the early am on my moto. My Taco is saved for Winter driving on the paved passes or camping. I also have a Jeep TJ, and it barely fits between the masses on the passes these days.

Found a couple sheets of stainless with a nice brushed finish that i pilfered from a remodel several years ago, just need to trim an edge and they will make a sweet floor pan.

Does anybody up here in the North have a set of seat sliders they would like to donate, or sell/trade for beer to the Kart build?

RE: uphill has the ROW, part of the problem is that a lot of people don't know, especially when they're from out of state and/or non-mountainous areas. Kind of like those same people often don't know what engine braking is and how easy it is to overheat brakes up in the mountains if you don't use your gears.

We've had this discussion several times, but I want to kind of bump the trail etiquette thread here where one of those discussions took place: https://www.tacomaworld.com/threads/trail-etiquette.435698/page-2#post-15669806 since it's always good for a refresher once in a while. It'd be nice if people could just rely on common sense and courtesy, but those aren't always as common as they should be. About the only times I've ever seen it have to be treated as a rule is when someone was being a dick.

But even if the rule was known, it sounds like in this case it might not have mattered. Someone who is going to get into a verbal altercation and then punch someone sounds like the kind of person who's going to road rage anyway. Given the circumstances I'm almost surprised it didn't escalate further.

I stand corrected. Remember discussing this on Colo4x4 years ago and no one could find a ROW.

    Thanks for posting it.

    Just 3 tons of fun!!!

ROW always goes to the vehicle traveling UP hill. Backing up down hill is a lot more dangerous.

And from what I understand, that ROW is even posted on this trail.

My standard operation is to give anyone the right of way that I can, no matter whether I'm traveling up or down hill. If I can pull off and make room, I do it... out of courtesy.

Pisses me off that asshole from CA decided to be a douche. My truck (and California plates) will be in CO by the end of the week... for the record... if you see me... I'm not one of those dumbass CA prick drivers.
