    I've got a land access issue that's been getting under my skin lately.
    These areas are just north of Crested Butte.

    The owner of a mining claim at the top of washington Gulch rd has posted a section of property that is not his.
    The usfs has told me I can remove tpost and signs as though they are trash but has insinuated that they would prefer that I stand down.
    They are working on some sort of land deal, possibly to get a permanent easement through the private land by trading a nice island of usfs land.

    Any of you guys know of resources for research into these kinds of access issues?
    The spots are a lookout called joint point, and the painter boy mine.

    So if I'm not mistaken this is the old 403 trailhead. I visited here back in 2011 when it was in use and... well I can see why the guy would fence it off if any of it is in fact his land. Most of that parking area was more a result of people driving off dirt onto grass and it growing and growing. And I found an article I'll link to below that talks about how it was worse than just that.

    My first question for you is the 'section of property that is not his' are you referring to essentially the west side of the property line shown by the assessor map, the two circles with 'signs' under them? Or the whole thing/more than that? Second thing, are you relying on what that assessor web map is showing as completely accurate, or are there survey marked stakes and such out on site? Because you should absolutely not rely on the web map. There are a whole host of reasons why that may not be showing things correctly. It may be right, it may be close, but given a) the county, b) the terrain, c) the type of property (mining claim), and d) it's general location, I wouldn't count on it. I can probably show you a good example of why if you want to see it. Beyond that is the access question just for the pull-off and potential camp area at the road, or trail access?

    Now it sounds like at least in part you are correct and some of it is USFS, or they wouldn't have told you that you could take the stuff down. You should take the fact that they are aware of it and are working to get an easement or a land swap as a good sign, because in many cases like this they don't have the time or budget to fight it, so they just roll with the closure. There are a ton of cases like this regarding FS access. This has come up a number of times with 14ers as well - outside Telluride with Silver Pick Basin and access to Wilson, in Alma with access to Democrat / Lincoln / Bross…

    From a little research it looks like this is a known issue and there are groups outside the FS that worked on it. From what I see things may have started coming up in 2016 (I have vague recollections of this, but honestly don't remember) and then a local mountain bike group worked with the FS to relocate the trailhead a few hundred yards up the road in 2018. Outside of the forest service, you might try contacting that group (Crested Butte Mountain Bike Association - CBMBA) as I'm sure they have a lot of info about this particular case. But you may get the same response, just let it lie for now because they're trying to work a deal with the land owner and don't want to antagonize the situation.
