    So I ended up going in a different direction with a recent purchase of a Savage 220 Slug Gun (20G) and now need to get rid of some ammo.     Once again, the ATF is clear as mud in their definition of SBR vs Pistol. However, the fact that they propose removing the tax on making these firearms NFA items, is a reasonable resolution. Additionally, accelerated form 1 processing of such items is appreciated. The big downside remains that NFA items are easily tracked, difficult to sell or pass to another individual, and difficult to cross state lines.

    I played the pistol brace game back in the early days of the first SB Tactical brace. The subsequent changes in the ATF's interpretation of their legality basically forced my hand in completing a Form 1 on my first two projects, not wanting to go to bed a model citizen and wake up a felon. The bottom line is this: The NFA (1934) is outdated and impractical. It should be repealed. The ATF should be absorbed into the FBI, where a regulated standard of the Department of Justice can be applied to policy and procedure. Today they are nothing more than a political pawn, that changes their "interpretations" as often as the wind changes direction and they need to be put in check.

    I think the way it is worded would mean you would register it as an NFA item in its current state with out a fee meaning it would have to keep the brace. If you wanted a stock you would still form 1 with a tax. Basically it is a way for them to make you register an AR pistol so down the road it will be easier to take. They are hoping by offering no tax, there will be less resistance b/c the herd will think they have won something but in reality, you gain nothing, your pistol stays the same as it is configured today, you pay nothing but it is now regulated more by being an NFA item.

    Once it is registered as an SBR, you can put a stock on it. The brace would have to be disposed of.

    That is the issue, everything is so vague. Many have interpreted this new reg. as it will only waive the fee if it is registered with the NFA under its current condition. (meaning with the brace). We are not sure if that means it becomes an SBR or if there will be some other classification made. I don't believe this is a case of "free tax stamp, and now I can put a stock on my pistol to make it an registered SBR." I believe to do this you will then need to pay the tax. I could be wrong of course. (it happens a lot according to my wife)

    I think the free tax stamp for a sbr is the wolf in sheep's clothing that they are trying to use to force registration. And it's not the actually the product they are trying to make it out to be if you know what I mean.
    It's going to be the Wish.com of tax stamp exemptions.

    I mean the thing is, is your configuration 'designed to be shouldered' or not. They don't want to put in any specifics since once they do, we'll go .1oz lighter or whatever and have it. I do like the free tax stamp for previously configured gear, though.

    This isn't even a reg yet. It's a notice of policy (with the ability to comment). After this is published, they may start the rulemaking process on an actual Rule that has what they actually will do wrt the millions of brace configured weapons around.

    Doesn't matter what the details are, in the end it is just a way to have millions of guns become registered or forfeited for being illegal in a configuration that they are currently legal.

    The ambiguity is as intentional as it is a "bunch of shit".
    Anything less than a clearly defined and specific law is designed to be subjective and enforced at a whim.
    I read it that you could legally purchase and possess something that would be illegal the next day based solely on the marketing material of the manufacturer? What kind of BS is that?

    It's beyond time to recognize both the NFA and the GCA as unconstitutional and illegal.
    Free men should feel no compunction to comply with the oxymoron that is an illegal law.
