Do not accept a partial refund. Accepting a partial refund is accepting that the debt to you is paid.

Having spoken with the assistant Crown Attorney over email, she said that the courts are giving him a chance to pay some of his debts, in that it will help him when it comes to sentencing. She then went on to say that she has very little confidence he will. She thinks we will get very little, if any, of the amounts he's agreed to pay.

    So there you have it.

Oh, but wait! It gets better. I am drawing quotes from my communication with the Assistant Crown Attorney for Ontario:

"All trials and preliminary inquiries that were scheduled in Collingwood from March 16, 2020 to present had to be adjourned. Many of those cases involved charges of a serious nature where people were killed or seriously injured, cases involving children and other vulnerable victims - cases with significant public interest considerations. Once trial courts in Collingwood resume, those cases will need to be rescheduled on a priority basis. In addition, the police have continued to lay charges since the pandemic started. Again, many involve serious charges that will need to be made priorities from a prosecutorial standpoint when courts are up and running."

"the unfortunate reality is that, when courts do resume, there will be difficult decisions that will have to be made in terms of which cases will be set for trial and which will unfortunately be stayed or withdrawn."

According to these statements there is a good chance we as plaintiffs will be out of luck. Conversely anyone considering questionable activities outside of a capital crimes nature; now would seem to be a good time.

I am hopeful that the Crown, should he be found guilty, will initiate restitution proceedings against Mr. McDonald for their costs. Perhaps informing the CRA of the unreported income would illicit some form of justice.

Please direct any questions to the officer who is now handling this case – PC Craig Steffler

Got an email with an E-transfer from our buddy Nate. He feels guilty and wants to return $100.
Spoke to Crown attorney and asked, if accepting it, will it free him from his debt. She said no it does not.
    Anyone else get one?

I'd reflect a bit before accepting that one. Maybe he's willing to negotiate his "guilt". Haggling does not constitute acceptance.

Received an EMT for $50.- today from Mr. McDonald. I will be contacting the Crown in regards to acceptance providing absolution from debt. A little independent research wouldn't hurt either. Frankly, at this point, I just want him to do time.

Wtf is $98.99? Shows he is just laughing at everyone playing this stupid game. By accepting all these stupid little amounts, he will look like a champ to the courts.
I don't care about the $100 he's offering because that's not what he owes me. He pays in full or it's nothing for me.

Same here. I want him to pay full price for the theft he did.
It bothers me that the legal system has proof and allows him to still play games.

I notified the Crown of the laughable restitution. I asked her this question:

Can guilt be reasonably implied by the anknowledgement of obligation for restitution and the pusuant act of partial restitution?

Following the logic; if he didn't steal the money what is he repaying?

He's already guilty with all the evidence, what's left is the charges. He's only doing it to lessen the penalty.

What a gong show.....This is almost 4 years since I got this thread created.

Please let me know if accepting any amounts from Nathan essentially cancels out the total he owes you. IF this is the case I can put it in the first post to let others know.....This thread is one of the top searches when searching CORE outfitters, so want everyone to be able to find it.

If anything comes up let me know so I can update the first page!

I asked the same question and was told by the Crown attorney no it does not. He still owes the full amount.

Please do not spread misinformation. I have provided relevant excerpts from the Crown's correspondence. According to the Assitant Crown Attorney:

    "Good afternoon,

I expect that restitution to all of the victims will be trickling in slowly.

No, you don’t forfeit your right to other monies owed by accepting this amount."

You are welcome to to provide the Crown with your legal opinion.

I’ll share these on the front page.

if I’m understanding everything he has been found guilty and is beginning to pay back increments of his debt? If you have been contacted regarding a certain amount you should be getting increments equaling up to that amount?

The thing is there's no guarantee that we will get the total amount.
I was told that by paying restitution, it will go a long way for when it comes time to sentencing. Gesture of good faith if you will. Because courts have basically shut down due to Covid , cases are piling up and when things go back to normal, there will be a lot of decisions as to what they are going to throw out to ease the load on the system. Serious crimes will take precedent so I believe he is biding time by showing he is trying to pay his debts in the hopes it can get thrown out by then. I could be wrong but makes sense as to why he is paying his debts in the least amount possible.
