Dealer SOLD my truck - resolved

    My 2018 SR Utility has been sold. Great truck. I need a farm truck. With my budget I made a deal with Village Pointe Toyota in Nebraska, 7570 Model.

    2021 SR5 Cement, Double Cab, Long Bed 4x4.

    1) Jan 9, 2021- I made a deal on a 2021 Tacoma SR5 Double Cab on With this dealership and Jim Thomas and Samuel Saintizaire - two sales people who helped me.

    2) Sam Saintizaire (salesman) told me to pay deposit so truck will be marked Sold.

    3) 1/12/21 Josh Brown (finance) charged $2,500 deposit for truck on

    They are supposed to mail me paperwork. No paperwork was mailed to me.

    On 1/15/2021 - I asked salesman why no paperwork? His response ""MY MANAGER DEALER TRADED YOUR TRUCK"

    THEY SOLD MY TRUCK - AFTER THEY SOLD IT TO ME!!!

    They would have NEVER told me, if I didn't push them for the paperwork.

    What should I do now? I emailed Toyota corporate.

    Appreciate you guys helping a local farmer.

    1/16/21 UPDATE:

    Dealership GM (Zimmerman) and Berkshire Hathaway Automotive CFO (Allan cady) scheduled a call with me in 2 hours via email.



      • Just finished the call. Call lasted 35 minutes. Addition to the CFO, the CEO of Berkshire Hathaway Automotive, and their Counsel was on the phone.
    CEO asked Mr. Zimmerman why this was done:



      • Mr. Zimmerman (dealership GM) spoke and apologized first.
      • Reasoning #1 from GM was "we have 5 salespeople on the floor. Truck was never marked for a sale."
      • Reasoning #2, "we have dealership policy never to sell truck to outside of state. We will offer you FREE flight right now, to come and take delivery of another truck."
      • Reasoning #3 "all the safety policies we have in place failed. THEre will be disciplinary actions."
    I reiterated - at no point was I told to "fly in and buy the truck"
    You had my DL. You have my address. You gave me purchase contract. You ran my credit, you have financing there. I have shipping quotes you acknowledged.

    Once I said that, GM became quiet.

    CFO STEPPED IN AND ASKED GM WHAT CAN BE DONE TO SOLVE THIS:



      • GM said he is busy, today, and hard to get other dealers on phone saturday, but by Monday will find me exact truck.
    GM asked till time on Monday to locate truck. There was no further talk of "come for delivery"

    GM then asked "if no red interior, will you take delivery?"

    I said, please let me know my options on Monday, thank you.

    We all agreed to wait till Monday. CEO gave me his personal cell phone, and told me to follow up with on Monday so that his employees are taking care of it

    Thats the update

    1/19/2021 UPDATE -Received Fed Ex overnight purchase agreement. Signed, and mailed it out now.

    They sent over the VIN of the truck with the options. I am uploading it here.

    They expect the truck 1/28/2021, and then sending it out to me. Per their time table, 2/8/21 is the latest I should have it in my driveway

    I bought the bedlight kit for my truck from Toyota, will return it now, as this has it.

    Truck is arriving at dealership today.

    They offered to find a replacement, let them. If they can't find a replacement, in what you consider a reasonable time, get your money back.

    While it totally sucks, you're left with the two choices the sales person gave you. At the very least, you may be able to leverage the situation to get some freebies installed on the truck they find for you.

    Get your money back. Go to another dealer. They can't be trusted.
    And make sure you mention to the new dealer what these scumbags did to you and see what you can get extra from the new dealer

    At this point, what's done is done. Give them an opportunity to make it right. If they can't deliver a truck to you within a week or two, get your money back and find a new dealer.

    I am still waiting "to hear from them" at all. I don't think they want "to find me a replacement"

    They want me to get a refund and go away.

    Guess dealerships like to take advantage of females.

    If you got a better offer, after you agreed on a deal, and took a deposit, and you sold it, why not call me, email me and tell me?

    Toyota Corporate, while not happy isn’t going to do anything, simply because Toyota Corporate builds cars.......their Dealer network are “franchises” that sell the cars....

    Dealer is offering you refund, hoping you go away.......

    first thing is .....what do you want......was the truck a good deal for you? If so, you’re deposit is a contract.......
    Btw, the sales Manager is going to keep you talking to the salesman, as an obstacle......
    If you want the truck, elevate past the salesman and the Sales Manager.......until you get someone who is concerned about legal liability.......

    I would shop elsewhere or go straight to the sales manager or higher in that dealership and no one else.

    Somewhere hot, flat and brown.
    If you want to make a stink about it in such a way that they make it right, blast that story all over every sort of social media you can find and make sure they know you're doing it. That apparently helps, says this old guy who doesn't do anything social media.

    Better yet, just let it go. Sadly, that kind of BS happens all the time - sometimes even as an innocent mistake when the GM and sales people aren't communicating. Get your money back and find another one. They aren't exactly in short supply.

    Truck was a good deal. But it was a7570 with red interior. Which I can't find.

    I do want the truck. Thank you for your post. I need to find the owner of the franchise.
