Nah - they put a lot of them in the Northeast too. Hard to find an A/C up here.

 

Does the purchase agreement have the vin number on it? If it does threaten them with Larceny theft. Raise hell like you never have before and don’t give an inch.
When it comes to dealerships and dealing with them I’m the biggest asshole they will ever experience. I’m not there to make friends.

I have a lot of respect for lawyers, and, of course, the law. But as a business person I can tell you the best way to resolve a situation like this is in person. Try to resolve the issue with them in person ... then escalate from there and look at your options ... once you bring an attorney into it (and there are many good reasons to do so) you are now in a whole new territory. One that you may not have the time or the money to engage in.

Honestly, the dealer knows they made a mistake. They may be bad people, of course, but I don't think you are in danger of losing your deposit.

You really want a truck ... once you escalate that will only take longer.

Sure, it sucks. But keep your focus on how they are going to make it right.

I can’t do it In person as they are 1652 miles away

I have written and asked for them to make it right

I am giving them reasonable time to fix it

I am not worried I will lose the deposit

I am sure they already financed the balance of the truck. I need to call the finance company on Monday to see if loan has already been funded

 

Got it. Sorry, I misunderstood. If they are already that far away, get the refund and start the hunt for another truck. I hope the good members here can help you with the search.

My comment on the lawyers was for the folks saying sue them right out of the box ... It sucks, some dealers suck, but get your money back and start searching again. Move on. They clearly don't care.

Let's focus our energy finding another truck! . Put that in motion and if they come back and make it right you can always stop those efforts.

Know this ... you will find that truck and all of this will be a funny story that you tell to your friends at the bar ... one day!

 

Report it to the police in their city and get a case number and lawyer up. You have them by the nads. Bypass the business manager and speak right with the owner. Give him one chance to make it right and today. Not next week.
Unless the owner is the business manger I guarantee he hasn’t a clue of the shady dealings going on.
Giving your money back is to easy on them and I would make them sweat it big time.

Julia, you’ve been given some great advice today from TW members......we’ve probably wound you up a little more, but just remember that Monday is a Holiday for most (MLK), and your emails, to get to the right person will take a few days (which will feel even longer).........
It will take a little time for the person that can make it right to get the info, find the truck and make it happen.....BUT you can help them by putting reasonable limits......
I like the multiple prong approach.........deal with the dealership and look for another truck from another dealership on your own......and breathe

One of the challenges I see is that a quick look in my area (Northeast) shows that SR5 / DC / Long Beds are pretty high in terms of price and not many long beds are available:

If the OP got a deal for $35K no wonder the salesperson probably jumped on another customer and probably made and extra $2K to $4K on the deal. And they figured they could sort it out later ... A very plausible scenario.

I agree with you ... give them time to work it out ... but keep on looking ...

Side note, I do think phone calls are much better than emails. I would be calling the Berkshire main office looking to be made whole, for sure.
