    my feiend who is a GM at a toyota dealer in Indiana and sells all the new landcruiser on Ih8mud said this about coscto

    “Costco deals are kind of made up discounts to be honest. They just partner with a dealer and collect a referral fee, but the dealer gets to makeup whatever price they want and call it a Costco price. Costco doesn’t have any say in what that price is.

    Not too sure on the CA market, but we typically sell Tacos within 10-days of arrival, so there isn’t really any room for discount unfortunately.

    This confirms my dislike of the concept of a deposit. You're fronting collateral for an informal agreement where the other party has no consequences if the agreement is broken. All inconvenience is on your end. That's putting a lot of trust in a business that you shouldn't.

    I'm kind of an old fashioned person-no money changes hands until the moment of purchase, with legal obligation on the other party to deliver.

    If the red interior is not available on the trucks in WA, you might look into replacing those items either by buying new or through salvage yard. Also lots of posts on others who have painted their various dash panels all colors of the rainbow.

    as a farmer we do handshake deals all the time

    however given the truck isn’t available locally for me I had no choice but to go the deposit route

    Red interior isn’t a deal killer

    I am going to get the WA one. Just need them to open and sort it out

    it was more of a “nice to have”

    sr5 DCLB cement 4x4 is all I need for my farm

    There are ways to do red interior after the fact, in case you can't find one. You could buy the door cards from an online parts house, or even better, you could post on here for a meet and swap. There are some people that buy red and would rather have black, occasionally fortune has it where they are close enough to do a straight parts trade.

    And then there's the third option - using aftermarket parts to get the red interior look.

    I think the thing I liked most about red interior is it allows for black seats (fc23)

    otherwise it’s fc14 interior gray seats

    That’s good news. Despite what others are saying on here, you may have had a legally binding contract (varies by state) and in some cases if you were to break contract you would forfeit your deposit (however there are always ways to get out of it, but easier for buyer than seller). Be polite and firm with the GM & CFO, and I would guess they will take care of this situation. The fact the GM / CFO are scheduling a chat with you demonstrates sincerity that they want to address it otherwise they’d just wait. You may end up being upgraded for a greater discount or get other perks, but obviously you are not going to be getting that specific truck. With today’s instant access to social media and reviews of businesses being what they are, they don’t want a bunch of pissed off would be customers sharing stories like that. There is a lot of competition in car sales.

    OP file a complaint with DMV. It’s a violation of CVC 11713(p) accepting a deposit for a vehicle that is unavailable. It’s a misdemeanor which doesn’t mean crap in CA, but it goes against the dealers record permanently, which hurts them in the long run.

    When were you supposed to take possession? Is there enough time for them to find a replacement? If so I would use this as an opportunity to get some upgrades or throw ins. I would try to see what kind of deal you and compose before scrapping them.

    That is why I insisted on signing an intent to purchase which listed the deposit amount and a receipt for said deposit. Also including an escape clause where refund would be refundable.

    I agree with Patos Tacoma - ask yourself what you really want in the end. Life is too short to waste your energy for the sake of ego or winning. The Universe might just be trying to tell you there's a better truck coming that you can afford.     I think they should find a truck anywhere in the country and have it shipped in for you at the agreed price. This will likely mean the dealer the truck comes from will not discount it for the dealer you buy from. So be it. Meanwhile your not traveling and putting an extra 1000 to 1500 miles on your truck

    Everyone speaking about “escape clauses” and “not contractualy obligated” is giving the OP a wrong info.

    once a dealer takes your money with the agreement of a vehicle to be sold, regardless if it was done via an email, text or southwest 5 dollar drink napkin and the vehicle and was not available the dealership has committed multiple violations.

    besides the mentioned VC above, PC 532(a) could be added. Theft by false pretense, a felony.

    OP’s money was taken without providing vehicle.


    OP I would definitely bring this up.
