    He’s not totally blind; He just can’t drive. He runs his own hogue shop, works the grill, and walks everywhere without the use of a cane or a dog.

    And this friend tells me that apparently it's a violation of ADA for the sheriff's office to not issue him a gun license...

    I'm not blind, I know how to shoot a gun, and I got my CCW with no issues, so I don't know; He's more or less come to terms with not getting a license and is just glad that he was able to buy the Sig for home defense (he also has a shotgun). I'm gonna try and talk him into going to the range with me and my friend so I can see how he shoots in a controlled environment!

    He should check the ADA for restrictions or allowances.

    I'm pretty sure if he is banned from driving that any sight related activity will also have restrictions.


    Based on his premise, he should be allowed to drive.

    He actually got his license at 16, and then macular degeneration set in sometime in his early 20s. He is going to be 36 years old this year and hasn't driven a vehicle on a public road in probably a decade, though he did have a valid license until recently; He had to formally surrender his license in order to obtain handicapped placard. He and his wife own a brand new Tundra that she drives him around him.

    He should be able to go to your local BCI (Bureau of Criminal Information) or equivalent in your state and get his criminal record. That will show why.

    I've got a funny story; In the summer of 2002, my Grandma bought a brand new Lexus RX300. She divided her time between homes in Florida (winter) and Maine (summer). My grandma's Aunt Edna (essentially my Great Aunt) lived in Wells, Maine; She was declared legally blind in about 1995 and had to give up both her driver's license and a mint condition, ridiculously low mileage PGA Edition 1989 Buick LeSabre (if I'd been 16 at the time, I would have taken that car in a hearbeat!). Anyway, this was either 2002 or 2003, so the Lexus was no more than a year old). We pull into Aunt Edna's driveway to pick her up to go to lunch. Aunt Edna still had some eyesight by then, and she stopped dead in her tracks when she saw the Lexus and asked "When the hell did you get a van?!?!"

    I kinda looked at her funny and said "Uh, Aunt Edna, that's a Lexus RX300; It's an SUV, not a van..."

    Aunt Edna was absolutely perplexed by the mere sight of a Lexus RX300, and still was not 100% convinced about what it actually was due to her poor eyesight.

    By the way, even though Aunt Edna was practically blind, I would be confident in her ability shoot an intruder with a 9mm handgun if she had to; She could most certainly not load a handgun at that point, but if tasked with simply shooting gun at a shadowy figure, she could definitely handle it!

    What about the other people living in the house.......likely to shoot one of them when they are taking a 3 am piss.

    Justify anyway you want. It isn't a good thing.

    A couple of thoughts about the OPs friend. 1) He might not be telling the whole truth. There may be something on his record which makes the sheriff think he's ineligible for a license. 2) If that's not true, he will want to know the reason for the denial. I didn't see it on the PA application, but several states ask if you have ever been denied a permit or license to carry in any state.

    Also, the PA permit excludes moving violations from the "Fugitive from Justice" question (30 I), so that shouldn't be a factor.

    I'd send a letter to the sheriff requesting an explanation of the of the reason for denial.

    He background check will show any arrests, court appearances, case dispositions, as well as outstanding warrants.

    My son was getting delays on his NICS checks because MA had a dismissed case from 2005 listed as still open for years. That was because the MA courts never entered the disposition into NICS. That was in 2012 and it took five more years for them to finally correct the record. Still it showed up when he lived in two other states when FFLs ran him through the NICS system.

    Food for thought. Even if he did have a MMJ card, it’s protected entirely under rights by HIPAA. There’s no legal way that would prevent him from getting a permit, politics and “legislation” aside.

    Has he tried filing under an adjacent county? Ohio doesn’t require registration in the same county you live in. I can’t see how an unpaid seatbelt ticket would prevent this, it’s not criminal.

    They creates a trap. If he answers "Yes" to the question about drug use, he's a Prohibited Person per federal law. If he lies and says "No" he's now committed perjury and if caught will become a Prohibited Person. It's the same as lying on a 4473.

    I held a CCL for 5 years and let it lapse. I reapplied in a different county and left off my SS#. From what I remember I got a readmission letter essentially. Due to my work I know I can pass background check so I figured that was the issue.

    Edit. If you have your license you're done. Above description is for my 5 year renewal.

    I would imagine they have ways of knowing if you have a card or not. My parents have theirs and they track the amount that you buy. I looked at getting a card but you are prevented from buying firearms. You can hold a CCL though.
