    I was nice once and got fucked over. Never again

    Getting on the freeway to take my son to school. I was in my beater crv, which was actually very well taken care off. As we are waiting on the on ramp (2 cars per light) i get smashed hard. The guy couldnt run because of the stop light. So we move over and i get out. 2 dudes and they are lit. Smells like skunk as soon as he gets out. Tells me that he fell asleep and he has no license and insurance. Dude starts taking shit out of his pockets and handing it to the passenger. He tells me if the cops show up he's going to jail. I ask him to shoot me a little cash then. He has none. He gives me a phone number and says that he will pay me later. I said ok. Dude takes off. I try calling him and he gave me the runaround. I got screwed and the rear end of the crv was fucked. I did make a report after but nothing came of.

    Being nice isnt always the best option. Lol. Fool me once....

    In truth, the driver is responsible for ANYTHING in the car. Doesn't matter who owns it or who brought it.

    So, in this situation.....
    Yes, the driver could be cited for possession, paraphernalia, expired/lack of proof insurance......possibly forged DL.


    I can't support how CA is handling its enforcement of laws......hell, grand theft is becoming a misdemeanor in CA.

    License isn't expired based off date alone according to people who live in AZ. Proof of insurance in CA and AZ can be provided digitally, which the OP said happened. You're left with possession of marijuana which is legal in both CA and AZ if over 21 and a pretty minor offense if the driver was not under the influence.

    My only concern would be....if you decide to have her insurance repair any damage....I would think the insurance company would require a police report.

    Maybe, maybe not. I've had others' insurance repair my cars in the past without any police reports or witnesses. It was enough to show them a picture of the damage in the rear, and their damage in the front.

    CA isn't perfect, but there's a reason people want to live here. And part of the reason is our laws aren't ass-backwards like Texas' cannabis laws.

    Replace the reference to a bong in that guy's comment and instead it's a bottle of booze. Do you still feel the same way?

    You get out. You take pictures of everything. The driver. Their car. Their plates. Where you are.
    You write down in the notes section of your phone your location and the time it happened.
    You take pictures of your damage.
    Ask them for their DLID and insurance information, which they are legally supposed to have and provide you.

    Then you contact your insurance and provide them with that information quickly.

    You also contact the cops, so they can send a car, and have an officer document what happened. Because insurance will want the police report number.
    And the word of a cop, in a court of law, is viewed with more credibility than yours. Which is a he said she said game.
    End of fucking story.

    How their day was, nobody gives a shit.
    This is a $1.3 grand repair, at most. Pennies in the bucket for the insurance industry that makes a shit ton of money. They will not care.
    If you have no deducible, great. If you have one, they'll probably waive it given that it was their fault, and not yours.

    Why do you do that?
    Because they might fucking run. They might not have valid insurance. Just because they took their ass to the DMV and paid $30 to get a license, does not mean they have insurance. Many people do not.

    Your state will determine police and insurance response. In Arizona, the police are not required to respond to collisions. They do not give a shit.
    In other states, perhaps they can and will send a car.
    CA supposedly has a budget that will pay for a not-insured motorist collision.
    To my knowledge, Arizona does not.
    Which means if in Arizona, they hit you, your insurance may pay you, and then go after the other party to be compensated for that dollar amount.
    Which they may not find.
    What happens if your insurance continues to send that person mail asking them to pay, and they throw away the mail?
    Nothing.
    Hell, your insurance may even call you, asking if you know where they are.
    Asking you, if you personally know, where this random ass person you've never met in your life who tapped your bumper in a parking lot, is.
    Genius stuff, really.

    The hit felt major, because it's a truck with no crumple zone sitting on a metal frame.
    It's probably fine.

    You can go to shop A, get a $1300 estimate, keep the money, and do what you want.
    Maybe PDR it. maybe replace with stock or chrome.
    Maybe buy trail armor.
    Or go to Shitty Shop B. Who will give a $600 estimate to slap a pound of Bondo on there. I would not recommend going within a mile of such a place, ever.
    Then your greedy insurance will accept their estimate, and believe it takes $600 to fix. Which you can try to fight. But they will not want to budge.
    They will think that you're an average dumbass.
    They will try to tell you, over and over again, that you should take your truck to Bob The Idiot so he can bondo it for $600.
    Because fuck you, fuck your truck, fuck the value of it, and fuck a quality repair, is what they think.

    Here is a valid question:
    what happens when you get trail armor?
    What happens when you take the $1300, buy a $500 high clearance Coastal Offroad kit, a $600+ quality MIG welder, fab it up, install it,
    and then you get hit again a year later? Which I guarantee you, will happen.

    If somebody in a Camry backs into it and leaves a scratch, does it become a matter of :
    -haha lmao u fucked ur car up bro, bye
    or
    -another claim. pay for ur mistake. and now let me see if the truck is fucked, it the bumper moved, if the bolts are out of position, at minimum

    The automotive industry is a big world. There are many facets of it.
    Mechanics, who learn to understand cars and repair them.
    Advisors, who speak for/represent the mechanic when speaking to a customer.
    And body shops. Who specialize in inhaling toxic fumes every day, and have earned a reputation of butchering every single car they work on.
    So OP should be very careful now, dealing with body shops.
    Their goal (most of them) is to take your truck, take all the money,
    and then "fix" it by charging $1200 to replace a light bulb with a Costco peanut, "wired" by dental floss.
    If you have ever worked on a car that has seen a body shop, you know exactly what I'm talking about and are not surprised.

    to be clear here,
    buying a welder and bumper fab kit
    is the correct response

    unless you prefer OEM, for the many benefits of
    -weak
    -no recovery points
    -no high lift jack points
    -no clearance
    -ugly


    What's wrong with a 50yr license?
    Is it supposed to be like California where it expires every 2 years for no reason
    and you show up to wait in line in an office just to pay another tax and fee, in addition to paying the yearly Breathing Air Fee and Farted In The Bathroom Fee

    I have seen OEM for ~$200 on eBay, Amazon, and local classifieds, both new and used
    And if you get an OEM, you will waste your life and time
    replacing sheet metal parts every time it gets tapped yearly
    instead of just going steel and calling it done
    aka "do it right or don't do it at all"

    edit: no time to read whole thread in depth, but I see mention of ramifications on the other party
    far as I know, such a thing, all it will do is raise their monthly premium by 10 bucks for a bit
    which is nothing to most people

    ah yes, the fantastic $20 per gallon gasoline
    and million dollar garden sheds

    a lot of people have been leaving on a consistent basis

    there is more to life than weed laws

    it is a minor traffic collision
    nobody has to talk about or take pictures of a bong
    and if police even come, it might be under the seat
    they might look might sober
    they might be sober
    there are people who crash sober
    and people don't crash high
    it seems irrelevant

    since when can people not go to Canada or Mexico because of a minor weed charge
    I am sure you can get a govt job by dealing with it in court, expunging it, and so on
    throughout history, many people have done so, with similar things

    Go see your chiropractor, get xrays. Easy $5k to cover your sore neck and pain in the rear.
    I did after getting rear ended at a red light. My hitch had to be replaced along with rear bumper.
    My frame was not damaged. I doubt yours is. But I bet you woke up with a sore neck like me. ;)
