    i feel you.

    A 90 year old man driving an F350 made an unprotected left into on-coming traffic and killed my father in law. He had Absolutely no business to be behind a wheel other than pride. Refused to give up his keys previously despite attempts from his family.

    Easy fix. The bumper is less than two hundred and the quarter will pop out easily. Might need some touch up paint. If you're lazy you can buy a new side panel and get the paint shop to paint it or shop for the right color panel from a wrecking yard. About three or four hundred in parts.

    Pocket the change...

    glad OP is not seriously i njured. i've been in 3 fender benders with a dash cam, one fairly serious that could have been really bad (nearly swerved into oncoming). with footage, i won each case with zero hassle.

    PROTIP: DO NOT TELL THE OTHER DRIVER YOU HAVE A CAMERA. let them dig themselves into a hole when they make their statements to their insurance company. one of the drivers claimed _I_ was turning left when i was clearly going straight in the footage, and the resulting impact would have made it impossible anyway. it's absolutely unbelievable how much people will lie to save a few bucks. combine that with below-average intelligence and it's just a total joke.

    people are filthy liars, but you can't lie against video. insurance companies LOVE LOVE LOVE dash cams... i have one for each of my 3 cars.

    I'd bet money the lady was texting. What happens in a case like this? Do the responding officers confiscate her cell phone as evidence? If not, she could deny she even had it with her.

    I agree... It is pretty amazing that people will lie about their fault in an accident. I mean, that's why we pay for insurance, right? As long as we have insurance we are covered for minor accidents. It all costs us more if there are court cases to prove guilt, or negotiations between insurance companies that are playing us.

    Oddly enough the insurance companies may not want to know if somebody was texting or not. My daughter was involved in an accident where someone in the car with her had a cell phone, she had none, and the guy she hit (turning right from a left turn only, against the light, and across two lanes of traffic) claimed she was on the cell phone. Neither insurance company wanted to know if the cell phone in question was being used or not, even in court with their lawyers.

    I was shocked... The guy was clearly at fault regardless of any cell phone being used, and our insurance company absolutely discouraged us from cell phone records.

    Did you ask why? I wonder if they didn’t want the door opened to your cell phone use as well, not that you did anything wrong but it might provide another tool to use against you. Cell phones are always sending and receiving data these days so maybe it’s hard to tell if it was actively being used or not aside from phone calls.

    I see cell phone records, in conjuction with the cars computor being used to establish how an accident occured as well as a time stamp of the incident, all the time in court cases.

    All they would say is that "if" the phone was being used at the time that it could be bad for our case. And yet my daughter swore up and down that no one was using the cell phone until after the accident, to call 911 to report it. It was a very odd trial. The entire thing blew many of my prior conceptions of court away to be replaced by confusion.

    Actually, my daughter lost her case. We had a really great insurance supplied lawyer and everything was going great... until the day of court when the insurance company switched lawyers. The lady that replaced our original lawyer was marginal at questioning witnesses and terrible at jury selection and opening and closing statements. The whole thing was a fiasco. But the insurance company was the one on the hook, so my daughter walked away free and clear dispite losing in court.
    Actually the guy suing her failed to get anything either. Apparently those suing must supply the court with a minimum they will settle for, and the jury didn't award him that much so he got nothing.
    As I said, my prior concept of how the legal process works was destroyed and replaced with confusion and contempt.

    Disgusting..and yes, say as little as possible except to the police.

    My wife's door was recently damaged by someone opening their door in a parking lot. I was 8 feet behind waiting to cross the lane to get to it..heard and saw the hit, heard the driver say "OOPS! Let's go!" to his friends (who all thought it was funny) and saw him then close the door. I already had my phone out and got a pic of the plate in case he tried to flee. He tried to deny it and I finally said "Look, I heard and saw your door hit, heard you say 'OOPS! Let's go!' and you all got a good chuckle, and saw you then close the door, so I'm calling the police and you can deal with them!" He didn't like that

    Damn. Just ... damn. SO glad you got out alive - best to you on the healing process.

    I'm now sold on a dash cam - you can actually see her traffic light was red just before impact. You should get a kickback for all of the purchases I and the rest of Tac World will be making...

    I was rear ended by a 40 ton semi doing 50mph while stopped for a construction zone flagman. My insurance company, Progressive, and the trucker's insurance company, The Mafia, got together and refused to pay for injuries and damage. I couldn't come up with $20K in ten days, I lost everything. Now I live on the street because I made a HUGE mistake and obeyed American bullshit laws. Only one law; kill or be killed. Worthless lawyers sucking the life out of America. As long as insurance companies exist, America will fail.
