    Constructive possession or intent: What they charge you with to make you pay for a lawyer for federal charges. Amazing how the laws around that concept have never been well defined through an appeals process. It's almost like federal prosecutors know its not a sustainable charge and tend to drop it after sufficient suffering has been inflicted so that it can never be properly litigated. That's just speculation. What's real is that people get charged with it and have to deal with mounting a defense. So, even if it is just a tool to use on people, it's a real and dangerous tool.

    The general rule is that you can't have all the parts unassembled to put together an illegal weapon with no other uses. So, that auto sear is probably fine if you happen to have a legally owned auto rifle (where the serialized part isn't the sear). Having a safe full of full sized rifles with stocks makes buying a 12" upper a bad idea unless you have an SBR or a pistol build already. I suspect the concept probably extends to all aspects of the BATF purview.

    Disclaimer: Not a lawyer, not a criminal, no first hand experience with this law (and hope to avoid it forever).

    How critical is it to stake your castle nut? I've seen some argue that you have to, and others say you don't have to.

    I have factory ARs with unstaked castle nuts and have never seen one come loose, and some have thousands of rounds through them. Is this a problem that only exists on the internet?

    Ive shot a lot of rounds maybe not thousands lately but last couple years i had my ar packed on my back atving or on my atv. Never had an issue of it coming loose

    I'm seeing that it's about 50/50. I guess an ounce of prevention will prevent a pound of cure. Mine's torqued correctly to 40ft/lbs, so we'll see if it comes loose or not. I also used a tad of antisieze, so it would prevent galling between the aluminum buffer and steel nut.
