    That might be how it works in your state, but it doesn't work that way in all states. Insurance companies know how to work with each other, and one blame is assessed, the company whose insured is at fault will pay for the damages.

    If you have any sort of injuries, then you'll likely want to hire an injury. Personally, I'd never use one that advertises on TV because they make money by getting quick settlements. Many of them will not go to court so if it looks like the other company may fight your claim, they'll try to get you to take a small settlement. If that doesn't work, they'll likely drop you as a client.

    Litigation costs money and juries aren't always sympathetic if they think the "victim" is pulling a scam. I knew a guy (not a friend) who was hit by a car and actually had some injuries. He went to trial and the jury found in his favor. They awarded him exactly $1.00 in pain and suffering.

    Why not read before you call? Not too hard, and will position you to ask better questions. If you don't read/know, all you can do is accept what they say.

    An internet forum has a mismash of counsel. Some good, some not so much.

    You have a copy of the police report in hand, correct?

    Call your agent and let them know you were the 3rd party in an accident. You're not 'filing' with them, you are advising. So if something hiccups on the other side of the table, your agent is the one who can fight for you. They will likely want a copy of the report.

    Call the other parties carriers and let them know you were the innocent bystander. Ask them if they have a preferred rental agency they want you to use. IE, assume they are going to do the right thing. Give them the report number and your name; they should have the report from their clients.

    You have no reason to call a lawyer at this point. And probably won't, assuming the other parties are insured.

    You have no reason to expect or pursue a new vehicle.

    You do have the right to expect a properly and completely repaired vehicle, using OE parts, not re-pops

    You have the right to have the repairs done at the shop of your choice. Using the Toyota shop where you leased from (or a shop they outsource work to) is a good idea, for obvious reasons (lease return inspections)

    Yea, it's a pain in the patoot to have to deal with all this. But I can assure you that one day, in the grand scheme of life, it will hardly qualify as a speed bump.

    First thing to do is be grateful you were not injured. Second is to never do anything stupid that causes the same kind of distress for others. Now that you know what it's like..........

    I honestly don’t get it. Frankly, it all looks to be relatively cosmetic. Nor is the truck anywhere near being totaled.

    maybe it’s just me, but I would check in with the dealer, make sure it was all OEM parts, check to see it was fixed, and I’d be on my way.

    It’s a truck, shit happens..

    You need to file your claim with the insurance company of the vehicle that hit you. That way you will not have to pay deductible. Only ever use your own insurance company as a last resort.

    I partially agree.

    The bed is replaceable, the door, bumper, hood, all of that is easily replaceable. Even if one tab is slightly bent, as long as everything lines up properly, you’ll never even see it. They’re minor things. I’ve seen people bang their door on someone else’s car that left a gnarly dent, it happens.

    where I do agree is if your frame was tweaked or bent. If they hit the front/rear wheels perpendicularly and it pushed the axles out of places. Big stuff like that can be permanent damage, that I would put up a fight for. But from the looks of the pictures, just get OEM parts and move on with your life.

    So long the part is OEM and the paint finish is in acceptable range of OEM, blended correctly, you are getting the truck you paid for. Majority of cars on the road have all had prior body work done before. Otherwise they wouldn’t look perfect. Just give the truck a nice look over on a sunny day when you pick it up. If the gaps are even and tight and there’s no shade differences in color I wouldn’t lose sleep over it.

    you can probably look into diminished value but I’m not sure how that works with leases. I know you can get a few Gs back if you owned/financed it.

    Well I can definitely state that both of the cars hit my front and rear left tires, I don’t know for sure if it did any damage on the under side but there is a possibility that there is damage. That is for my adjuster to take a look at. I can’t even pop the hood open to see what’s going on in there because it’s stuck

    OP,

    First and foremost, glad that you are okay. In the big scheme of things, that is all that matters.

    Lots or keyboard warriors here ... and also some good / sound advice. The political stuff -- who needs it at this point. You don't. And it is boring and predictable.

    As has been stated, connect with your insurance company and understand their process. Connect with the finance company and understand their process. Also connect with the dealer you leased from -- and see what they have to say. Document all of it.

    But one thing I want to call attention to -- and that is the fact that you said you have a sore knee and perhaps other problems. My only advice to you is make that clear to the insurance company ... and get checked out by a doctor as quickly as possible. Just to be safe. You don't want to be sore today and then four to six months down the road have any medical issues related to the accident. You are probably fine -- but I would recommend being thorough on that front. And let your insurance company know that you are going to see a doctor. Document that as well. You just never know. Overly cautious? Yes. Sound practice? I believe so.

    Not true. The drivers at fault are responsible for diminution in value. Would you pay the same price for a truck that has $10k in repairs vs one that was never in an accident, all other things being equal? The majority of buyers would run the other way and look for an alternative truck to purchase. There is the cost of repairs + loss of use ($50/day rental?) + diminution in value = total settlement cost.

    I got T boned in an accident, told my insurance the first day that I was fine. Few days later... Pain! Got some X rays done and had some visible injuries. Went to a chiropractor for 6 months. Insurance didn't say a word until the very end where they declined to pay for the visits. I'm a firm believer that insurance is only there to not pay for anything. Any way they can make you pay, they will. Luckily for me, my chiropractor was cool and didn't have me pay a dime.
