    I had a head on crash with my Dakota. $18,000 damage and the insurance wouldn't total it. I brought it to the best body shop I could find. They have a laser frame alignment set up and were able to bring the frame back into alignment, supposedly closer then the factory specs. I drove that truck for another 150,000 miles and I dare anyone to be tell that it was ever wrecked. My girlfriend ran her car into a telephone pole and caused $8000 damage. We brought the car to the same body shop. Once again, I dare anyone to tell that it was ever wrecked. My point is that there are really good body shops that do really good work.

    This thread reads like someone trying to get out of the truck and get something that they should have bought in the first place.

    OP, I agree it sucks to have a wrecked vehicle, but this might be one of the few times it is better to lease than buy IMO.

    Keep in touch with your insurance agent. Legally they have to tell you if your insurance will go up if you file a claim. They can walk you through all your options. It sounds like your best option would be to wait until you see money from the other insurance companies. Or ask if you can get your deductible back after they get the settlement.

    Check to see if in your state, the parties responsible for the accident have to pay for the devalueization of your truck. We get that here in Ohio. My son has been hit twice by drunk drivers while coming home form work. His 2013 Civic lost $2500 first time, and another $2500 the second time. We filed a simple form provided by the state. Sent it back into the provided email address. He got checks from the guilty parties, until the liens the states placed against them, were paid off. Don't know how they came to the $2500 both times. The accidents totalled $8500 for the first and $4500 the second one. Must be some complex algorithm...

    I live in MA, a no fault state. My procedure is always to call my own insurance and provide them (among other things) the other person's information. They then deal with the other insurance. If the other company calls me that's one thing but I'm not seeking them out..that's why I pay my insurance company, to represent me.

    Honestly, I thought this was how most insurance claims were handled. Via your own insurance. Your insurance sure as hell doesn't want to pay a dime, so you can bet they will defend you.

    Hi folks,

    Good golly, how did this go from OP asking a question to jumping on his shit? (Some peeps)

    I have read some of the wildest crap in this thread. I am the only licensed adjuster in multiple states and have managed a large carrier. (Not to peacock, but to say come folks).

    He cannot get DV. (Diminished value) and the leasing companies never pursue it.

    He does not need an insurance attorney. Unless his claim is being denied or there is a question of bad faith. He can get a PIA (We call them that , but personal injury attorneys). Unless he has significant injuries they will have him treat until he hits his maximum 10k in med pay and then demand limits from the at fault parties Bi (bodily injury ) coverage and then take a third for doing nothing more than some letters.

    The adjuster is going to make the call on the truck. I saw some sway to the frame up front the way that lower front end was hit. With him not being able to open the hood he may have structural damage.

    It should be a non chargeable loss since he is not at fault. One call to Progressive 800# customer service should confirm this.

    And give OP some empathy. Leased or not, new Tacoma, hit pretty hard while just sitting there, has to spend time dealing with this .

    The only restitution the OP would have in a case involving a leased vehicle would be for any personal injuries sustained. The OP could also sue the other insured for loss of income due to a injury caused by the wreck. The OP could also get reimbursed for car rental due to the vehicle being out of service while being fixed. The OP could also sue the Leasing company if he so chooses for damages. But this would be a bit of a long shot.

    The OP wouldn't be entitled to any damages (excess) covering the vehicle as he/she has no ownership of the vehicle.

    The leasing company (who owns the vehicle) will most likely settle with the 2 insurance companies to cover the damage and the repair to their truck.

    My mom is a lawyer specializing in insurance law =).
