    JB what do you do if someone checks the Non Binary on the 4473? is there non binary option when you input the information?

    While waiting for JB to answer, I'll share my recent experience.

    Last fall, wife and I ended up buying a Glock 44 and a Glock 45 MOS. As I am filling out the form, I come to that question - obviously reworded since the last time I filled one out. Asking the proprietor (in my usual sarcastic tone) what the hell "non-binary" meant, we had an animated conversation. He ended it saying something about not selling to someone who selected that option, due to their mental state.

    Sure, not politically correct, and today, probably not even legal. And he was dead serious.

    Of course, around here, I don't think he would ever have the opportunity to worry about it.

    They shouldn't use gender for identification because its to easy to fake, they need two boxes which you would check one .

    I won't get into the political aspect of it however it's a requirement on the 4473 now

    The program I use auto completes the nics page so I assume it transfers over as marked

    ATF says this:

    To buy a firearm from a federally licensed dealer the buyer is required to provide evidence of identity so the dealer can establish that the buyer is the person shown on the ID. The buyer must also check a box on the Form 4473 identifying his or her sex. There are two choices, male and female. According to the alcohol, tobacco and firearms folks, the buyer would need to properly identify him or herself so that the dealer could run the buyer’s name and sex through the National Instant Criminal Background Check System (NICS) to determine if there is something in the FBI’s database that might disqualify the buyer.

    Many states recognize that there are more than two acceptable genders and are issuing official identification, such as drivers licenses, that are non-binary. A non-binary license allows the driver to select the gender identity of “X” which is a term to encompass genders that are not exclusively male or female.

    The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has advised its licensed firearm dealers throughout the country that they are permitted to accept a state issued non-binary license to identify the buyer of a firearm. In the same question and answer session, the ATF was asked what would be the effect of a buyer, ostensibly someone who identifies as intersex, who refuses to identify as male or female, on question 6, Form 4473.

    The response of the ATF was that the dealer would not be permitted to complete the sales transaction because the NICS database would be unable to accurately identify the buyer by gender. In other words, all entries in the NICS database are coded by male and female. It is not likely this will change soon.

    Unless the person has a valid permit which qualifies as an exemption to a NICS background check. (4473 Box 29)

    I just ran up stairs and chatted with the guys from ATF and they pointed me to this....

    When Completing the ATF Form 4473 when non-binary identification documents presented The Regulations at 27 CFR 478.124 state in relevant part:

    (c)(1) . . . shall obtain a Form 4473 from the transferee showing the transferee’s name, sex, residence address (including county or similar political subdivision), date and place of birth; height, weight and race of the transferee. (c)(3)(i) Shall verify the identity of the transferee by examining the identification document (as defined in §478.11) presented, and shall note on the Form 4473 the type of identification used;

    The regulations pertaining to the National Instant Criminal Background Check System (NICS) at 28 CFR 25.7 require the sex of the transferee in order to conduct a firearms background check. This information is captured on the ATF Form 4473, question #6, which requires the transferee to indicate his/her sex (not gender) by checking or filling in the applicable box adjacent to “Male” or “Female”. Transferees must select either “Male” or “Female”, but cannot choose both or write in “X” regardless of what is recorded on the transferee’s identification document. If the transferee refuses to complete question #6 then the FFL may not transfer the firearm.

    And they did tell me that it is going to be changed soon possibly as its not going like they planned and causing a ton of rejected BG checks on Federal and State levels and over loading the system .....:rofl::rofl::rofl:
