They destroyed my 2 month old taco

    MA is a "no fault" state for personal injury, but not for damage claims. If you're more than 50% at fault, your insurance company pays the full cost. Then you get about five years of surcharges on your insurance. Plus at fault accidents pop up when the police run a license check on you.

    You can appeal an insurance company decision on fault to the Merit Rating Board. Good luck, as from my experience they don't buck the insurance companies.

    Unlike some states, if you're both 50% at fault, no one pays the deductible or surcharges.

    I believe you also have to report the accident to your insurance company (it's not law, but regulation) and then they hash it out with the other guy's insurance company.

    I never talk to the other guy's insurance company. Like you, I pay my insurance company to process my claims. The other guy's insurance company is trying to limit their liability, not yours.

    So I spoke with all the insurances and also the person representing me. I’m stuck paying my deductible, based on the fact that there were 4 cars involved in the accident, and all the insurance policies are at 10k damage so it won’t be enough for their insurance to fix my entire car. Even after my car is fixed, There might be the possibility that I won’t get it back from the other insurances, because who know how much they’ll pay out. Freaking sucks that I’m basically stuck at a loss unless my car is totaled. My insurance says that it’s a 50/50 between repairable or totaled based on pictures. so I have to take it in to get it inspected properly to know for sure.

    What the insurances are basically going to do is split all of the policies between the 4 cars to cover for damages so that’s only 40k total

    Hey OP, glad you are okay.

    I know this advice will not help you right now but maybe it will help someone else (or help you in the future). Add "uninsured/underinsured motorist" coverage to your policy. I believe it costs less than $50 per year.

    I had to use my underinsured coverage in 2018. Got rear ended by a guy with only 5k in coverage. Damage was 12k. Filed a claim with my own insurance company and never paid a deductible and my rate did not increase.

    Definitely going to have to do that. It’s a maybe still on a loss on my side. She said it’s a possibility that I might not get refunded 100%

    Don't worry about getting the cost of repairs back from the other insurance companies and stop contacting them. Work with your insurance company That's what you pay for. Your insurance will cover your repairs and/or replacement and then they will go after the other insurance companies or owners. It's called subrogation. Subrogation is a term describing a right held by most insurance carriers to legally pursue a third party that caused an insurance loss to the insured. This is done in order to recover the amount of the claim paid by the insurance carrier to the insured for the loss.

    But I thought that the other insurance companies were only liable for the $10,000 in the policyholders policy. So if my insurance goes after the other ones they’re only able to get what’s under their policy which is 10 K

    I guess I am most interested in your statement that leasing companies do not go after diminished value. If a lessee turns in a vehicle with too many miles and in poor condition, he is going to be hit with extra charges. It would seem a vehicle turned in by a lessee with diminished value (assuming that it is diminished) due to an accident would be subject to the same treatment. Could you elaborate?

    That's just it, though. You'll probably win, but collecting is another story. Unfortunately, it could will end up being a blood from stone scenario if they really are judgement proof as I suspect they are.

    If they don't total it just sue the person in the car that hit you. Sue them for property damage and if your insurance company is good they will sue their homeowners or them personally for the balance not covered.

    I guess what I should say about personally suing them: go for it if the cost is low, but don't expect much.
