Very bummed out this morning. I was driving to class in my 1996 Lexus SC300 (with manual:thumbsup:). So I make a left hand turn onto the street where the school parking garage is off of, and I see a pedestrian waiting to cross in a marked cross walk. So I slow down and stop to let the pedestrian cross and while she is crossing all of a sudden a loud noise and something had defiantly hit the car, ah @#$@!. So I get out of the car and there is an older guy and the remnants of his scooter behind the car, so I call 911 and the cops role on the scene. There were plenty of witnesses all of which said that I had come to gradual stop, and had been stopped a little while before this guy hit me. They cart the guy off to the hospital in an ambulance, he was conscious but his hand was cut up and I think he pretty much flew into the curve of the trunk. I didn't get cited or anything but my rear bumper defiantly is going to need work:(. When I get home tonight I need to check the exhaust to make sure he didn't crimp it up or anything. I hope the guy is alright and all but I sure as heck wish he had been paying attention so that neither of us would have to deal with this. I'm just scarred he is going to find some nasty attorney and somehow find a way to try and sue me:evil:, even though I would have the PD and witnesses in my favor. I feel fine, no airbags and I was wearing my seatbelt so thats good. I think the cops said he had insurance but I'll be getting a copy of the police report tomorrow. Since I don't drive that car much I didn't have comp or collision on it but since I didn't cause the accident and hopefully it will be the other guy's insurance paying I should be safe, if not I might sue for damages. So in short I HATE SCOOTERS!

Edit: I left the taco in garage because I stipped the wax off last night and hadn't gotten around to polishing/waxing it and it looked like rain. I think though that it might have been for the best since running into the back of the Taco would have probably hurt a hell of a lot more then the curved trunk lid (either way sucks but still).

Bummer! I don't think there is a way to get out of responsibility for an accident when you crash into the back end of another vehicle. His insurance should take care of it. There are getting to be a lot of those scooters on the road these days. I have a friend that used to own a motorcycle dealership. He sold tons of those scooters to drunks that had lost their license, since you don't need a license to drive the smaller ones.

I would not worry, he is the one who hit you. You were stopped. Was he on a cell phone?

Sorry to hear about your accident. glad no one is seriously hurt. since you were the one that was rear ended you should have no problem getting money. unless he is broke and has no insurance, then you're screwed, but lets hope thats not the case :(
