Curious if anyone has some advice:

I'm in the state of MA, full time career and paid hourly.

Company wide, we all had to do a system update. I told my leader I would start the update right as I went on my lunch (50 minutes unpaid) so it would be updating while idle and therefore minimize/eliminate loss of production of myself, which was fine.

I returned and it was still updating, and unavailable for my usual task for another 20 minutes.

I sent my leader an email immediately upon completion (as we need to account for non-production time outside of break/lunch) and explained the above. I got a reply today asking if I am going to make up the 20 minutes or use personal time.

Maybe I'm wrong, but how is this legal to force me to work extra for their forced system updates or make me use my PTO?

Well somethings not right because mine doesn't move around either. Either you have the longer and heavier antenna or you have the the weaker spring or something? It shouldn't be moving.

IDK if that is legal or not but it sure is a scumbag move! It really doesn't sound legal.

By doing the work didn't your computer show that you worked thru lunch... Tell him to dock you the 20 minutes and you want overtime for working thru lunch. I don't really know. I don't have the best people skills especially when pissed off.

This all depends on whether or not your signed a company handbook with company policies in the beginning of your time there or if you had to sign any policies that needed to be updated throughout your time of employment. I have worked for many small companies that turned corporate and they like to throw in things in fine print for people to sign that cover their ass in situations like this. If you didn't sign anything, I would take the situation to HR.

If they have an HR department and notify a employee of the changes and they have a receipt of you reading or signing it then yes they can do that. They can't force you to use your PTO time though due to a computer related error.

I will have to look, though last year when my area ran out of work before noon we were still paid for the day if nothing else could be found.

It seems odd that a forced update of the company laptop that had to get done would be grounds to make the employee use their PTO or make it up, it wasn't a small update and the email instructing us to even said it will take roughly an hour to do.

That's just it, an employer can do what they want if they've notified you and they're not doing anything illegal. I'd question the legality of this one though

Did they notify you about this ahead of time before you did the upgrade or afterwards

For the most part, we have acknowledgments we have to sign to make sure we're up-to-date on the rules. They're usually annual acknowledgments, and state the same as the year prior. If you do this, you could be terminated. If you do that, you could be terminated...

But there are plenty of rules that change with seemingly little or no announcement. Even some of management is fuzzy on some rules. Half of HR is outsourced now too. So for certain rules, it really depends on who you ask.

Of you are salary then yes, if you are hourly, they can not make you use your PTO against your will. I would ask to see this policy in writing. The company as a hole can change things up at anytime but one specific supervisor can not make up their own rules.

I'm fairly certain it is because you are hourly, that they want you to make up the time to get paid for the entire day. If they were smart about it, they just wouldn't pay that 20 mins. Otherwise if you were salary, that would make sense they said that.

After. Did it Wednesday (started it at lunch right as I went). Sent the email advising of the overage Wed late afternoon. Got the reply today.

As do we. I'm fuzzy if this is even legal by state law though especially since I'm not a salaried worker.

20 minutes? Wow. Your employer is a douche.
