My small claims action ("civil court") is against the LLC and its 2 members (Wyatt and Alana). Same process of filing complaints against all 3 with OCDA, State AG and the FBI.

The LLC and members were served the court summons a few weeks ago. My small claims hearing is June 25 via Zoom.

Winning the judgment is certain based on his admission of guilt in one of his last texts to me in March 2021. Collecting the $10,000 ("max" for Small Claims) is doubtful and costly. Liens and garnishments might recover something in the future.

When I spoke to Rick Bradley a few weeks ago, he was confident that with 5-10 local SoCal residents that his DA will dedicate the resources to prosecute Wyatt and Alana on a criminal basis.

He did not believe the State AG nor FBI would pursue the case due to the "relatively" small dollar amount compared to massive corporate fraud.

I used "iMazing" software to download and organize my text communications with Wyatt and Alana, and to share with Rick Bradley. This documented her complicity in the manner. Whether it was Alana reading and sending me texts remains to be seen, but Wyatt will need to explain why he was impersonating her and providing fraudulent information to me.

    Tuffmudder,
That is some positive news to hopefully get criminal charges brought on to both of them. I'll call Rick as well this afternoon.

Could you send me the civil filing process for OC? It was not very easy to follow. Mine would be above $25K, so the unlimited version. I would like to file a civil suit online. I did file complaints with the State AG and FBI as I previously mentioned. All I got was a letter from the state AG, but no commitment to action. Also, let me know if there is a complaint form to fill out for the OCDA as well.

Hopefully Rick Bradley can get his DA to press those criminal charges. He will certainly have plenty of witnesses.

I appreciate the information and assistance.
    Thanks!

See attached for a partially completed OCDA complaint form. You can customize for your situation and email to Rick Bradley.

My loss was $16,000 but I went the easy route of the $10,000 filing. I did research online before I filed, and have summarized in the attached Word document. There is a very useful Legal Aid Society to assist you in the higher $$$ civil suit.

Add another vic to the list.

I'm out $5k for Crawler box, Fj T-case, and labor, ordered May 2019. I heard all the same excuses reported here, parts delays, blame on MC, health issues, family health issues, blah blah blah. They had my truck for 6 weeks for a 2 week job. Fed up with the BS so I flew down and literally stood over them while they reassembled it and demanded he release my truck. Then, in my complete and utter stupidity, I agreed to have him perform the remainder of the work 2-4 weeks out "when the replacement parts arrived", foregoing a refund at that time. The story went, "your MC Crawler box was cracked and I had to send back. It's on Marlin Crawler, nothing we can do..." along with promises made to "make things right" at a later date. I heard from him 2 more times, more stories told, but on the last call I demanded a refund, to which he agreed, but more excuses via sms as to why refund was delayed then he ghosted me.

The only parts they installed were parts I delivered to them w/the truck & Diffs from ECGS, and FWIW the tech who performed the work did good work. No complaints there. But I never received the MC Crawler box or manual t-case.

I'll be filing a complaint with the OC AG as noted in this thread. I'm not a Socal res but strength in #s.

I had my hearing today in OC Small Claims Court. Neither Wyatt nor Alana appeared. I was awarded a summary judgement of $10,000 plus court costs.

Winning a judgement is one thing. Collecting is a whole other matter!

    Same crap everyone else got
That would most likely mean you would sell the debt to them and doubtful they would do that knowing there's no recourse really for collecting.

True but there's plenty of ways to do it, some faster than others of course. That said judgments are good for a long time.

Just came across this thread. Wow. Just wow. I've known Wyatt a long time, same as Monkeyproof. I never knew it was this bad. Any updates from the victims? I hope you guys get all your money back.

I Know him in the sense that he was always at some off road events that Monkeyproof and I were at. As Monkeyproof was saying, he always had his little entourage with him. Always had his little clique. Didn't talk to him much. Funny, because a year ago, i saw him at another event in his GX and he acted like he was my best friend.
