Shit neighbor

    So I have some really nasty neighbors that simply put, seriously trashed their house. I won't get too far into it but as an example, they pour engine oil out in the street instead of disposing of it properly.

    The home owners association is putting a lien on their house because they refuse to fix any of the problems. Some of them are expensive but others would take 5 minutes and cost nothing and since they've done nothing, I have no simpathy.

    What does it mean for the associan to do this? Does it just simply mean they can sell it or is it worse?

    That sucks, sorry to hear that. Good thing you have an HOA. Not sure what the lien does, if they can actually take the house or just get money if they ever sell it.

    What the HOA can do depends on what the association’s documents dictate. There is the possibility that the HOA could forclose on the house.

    Basically if the HOA places a lien, they cannot sell or refi the house until the lien has been satisfied (paid). Cross your fingers and read your CC&Rs to see if the HOA can foreclose on the house.

    The HOA is pretty big their operating budget is around $30m. I imagine they have the ability to do whatever any other HOA can do.

    My HOA can put a lien on too. I was previously in violation due to my tenant having Christmas lights still up. The property hits the market next week. My realtor has experience and says the HOA can really mess things up if they want to. Fortunately she talked everyone off the ledge. I would be unable to hide my frustration had I been involved.

    Don’t think the lein helps much if they are owners. If they are renting then maybe it gives the owner some incentive to terminate the lease.

    We had deadbeats near us as well, for many years. Trash cans full of beer bottles. My dog used to go into their house through the open front door. Some meth lab explosion stuff too. Finally they sold and it flipped.

    The sellers market is your best ally. Even stupid people like money.

    Oil in the street! You have kids? Imagine they get into that somehow or someones pet. They pour oil in the street call the police and EPA.

    When they were dumping oil, someone (not me) called the police. They sent the fire department out to clean it up but said they couldn't do anything and that it was a civil case. I wasn't there but nothing really came of it.

    I can't imagine they could get their live together enough to sell the house. They spend all their time thinking on some POS cars. When they get tired of them, the rev it bouncing the rev limiter until the engine blows. You would think I live in some rural back woods area.

    Our HOA isn't bad. They deal with snow removal, trash, etc. The only time they get involved is when someone is selling a house.

    The HOA was here before I was. When I bought the house I agreed to the terms. Most of what my HOA deals with is commercial property. Developers keep coming in trying to buy houses so they can tear them down and build high rises with no plan on how that's going to affect traffic or the surrounding neighborhood. In that sense, the HOA has done a good job protecting the community. On the other hand, they've wasted money and using my fees to pay for tennis courts that I don't use but nothing's perfect.

    An HOA can issue a lien if there are fees due such as unpaid fines and association payments. To the OP’s point, the more complex the development, living with or without the HOA gets tricky. Also municipalities that have lax zoning standards and enforcement comes into play. Good luck OP.
