can i deny insurance repairs.

    alright well here's another post by me so i can get some help. My truck was rear ended and needs a new frame. It has already got approved by insurance but the frame is 12 weeks out with an additional 4 weeks to swap the frame when it is in. I will be out of a vehicle for a total of four months. Can i deny repairs and try to get paid out? Not only is being out of a vehicle for 4 months a concern but also the loss of value and integrity of vehicle after the swap is done. image3.jpg image2.jpg image1.jpg image0.jpg

    Depends upon your state. They can "cash you out" for your repairs and give the damaged truck back to you, but why would you do that?

    Do you mean force the insurance company to total the truck based on your inconvenience?

    The other party insurance should have to cover a rental for as long as you need as mentioned by others.

    Just know if you are able to cash out. Once you take the money you’re on your own and will have zero recourse should any unforeseen issues arise.

    Exactly. That's why I said "why would you do this?".

    Best to try to get rental from other parties' insurance and deal with the inconvenience as best you can.

    So you want to "take the money and run"?
    I guess that may depend on the fine print in your auto policy. Will they pay you for the loss or the lienholder or only the body shop? I don't know the answer.
    Not the same, but I had to deal with an arson claim on my home owner's policy. The amount that would have been paid to rebuild would have exceeded the amount we settled on for the loss - by about 50%. I had no inclination to rebuild so I took the lesser amount. Don't know if that can apply to a vehicle insurance policy.
    Anecdotal side story: I rear-ended a car at a stop sign because of extremely slushy conditions. Being an under 25 driver I did not want to involve my insurance company, so I offered to pay cash. This car was typically on the road during my drive to work time. I saw it many times over the next few years - it never got fixed and they pocketed my money. That pissed me off because my intent was to make them whole and they basically flipped me off. Did they have a 'right' to do that? I suppose so. But to this day I feel it was the wrong thing to do. JMHO

    I think you can take your truck to another body shop. My old car was damaged when it was at the dealer. They wanted to fix it at some no name body shop. I did my research and went to the best one. They covered it. You could go to another body shop and get another estimate and see if it totals out. I forget what the percentage is, but if its like more than maybe 50% of the value of the vehicle to repair it they consider it totaled. That's just an example, it might be like 75-85%.

    If you do fix it, your resale value, if you were to sell it, would be compromised because of the reported accident, and your frame in all honesty probably wont be as strong. I'm sure someone on here can weight in more. I would try another shop. What was the repair estimate?

    Also their insurance should cover your rental. or if you have underinsured motorist protection on your insurance.

    The insurance has already made the assessment of the truck and is not totaled and can be repaired . I highly doubt they will total out the truck because you are not happy with the wait time or personal concerns .You might be able to get a second opinion on the inspection of the damages and submit it to your insurance company . It would be out of your pocket to have it inspected . Have them fix it and give you a loaner . Once all the repairs are made sell it if you are not satisfied with the outcome .

    You can get a check from them and fix it yourself. They aren’t going to total it if it can be fixed & good luck getting a “diminished value” check.

    Were there injuries? Whiplash?

    you should be able to recover the difference between value of un-damaged and repaired = diminished value. The insurance company will try to tell you it is good as new - CarMax or any other damage tracking firm will tell you its' market value is less. You are entitled to the difference and your insurance company should recover this along with damage costs from the party at fault. Expect your insurance company to do nothing unless you take them to the mat. GL. That sucks!

    Like I said in OP's other thread: not in CA. DV claims are few and far between here.
