OVTune does not change the version number. I believe it only modifies several tables that the code uses.
What these smog stations may do is look at the version of ECU, match it to a database and that is it. I doubt they'll run a bit for bit data dump and compare it to the factory ECU versions.
Until someone goes in for a smog check with a tune, you won't know for sure.

But, after 42 years in CA, I got out last Oct. Reassembled my AR the way God intended, loaded up on 'standard' capacity magazines, purchased a handgun of my choosing and never looked back.

It was the opposite. Engine had to be from the same year or newer vehicle.

I am curious to what legal authority they have to check the ECU if the owner did not give permission. Is it a form of a search. I think they would have to have some evidence that the vehicle has been modified before checking the ECU. What if they find evidence of something other than a tune that may effect emissions. Does law enforcement have the right to check the ECU or any other data collecting device in the event of an accident or even just a suspicion of say speeding. If the tail pipe test results in a pass. I don't see what gives them the right to check the ECU. But I am no lawyer so don't challenge them on what I have said! Do we even know what they might be checking? Could they just be checking for codes?

New cars are exempt from smog for 8 years. “Starting January 1, 2019, if your vehicle is less than 4 model years old, you can pay a smog abatement fee instead of getting a smog inspection for the first 8 years that your vehicle is registered.” so this could apply retroactively to some 2015 models if they paid the abatement fee.

1996 and newer vehicles (OBDII) haven’t been subject to a tailpipe test for years. For those cars the smog test is done through the diagnostic port and various checks are performed against the ECU. If you are smogging your car then you’re consenting to have the smog shop connect their equipment to your car’s ECU. If you refuse then they won’t smog your car simple as that. Technically no one is forcing you to smog your car but if you don’t and it’s required then the DMV won’t renew your registration. On the bright side, as I stated above and in the CVC tune thread new cars are exempt from smog for 8 years which includes every 3rd gen although 2016-18 folks would have have to pay the smog abatement fee to be included in that exemption.

    Strange isn't it haha..

I love part of Jello Biafra's mayoral campaign in San Fran many years ago..create a legal board of bribery, in order to set fair and standard fees for building code exemptions, police protection, protection from police, etc etc

I was referring to the use of the random check points. Why would they choose to check a particular vehicle. Is it every vehicle? If it is random. Is it truly random?

I guess the good thing about having a new truck is not having to worry about a smog check for the next 8 years
