    16" is shortest length you can have for a rifle (that includes the normal flash hider) before you have an NFA item. For a pistol (AR with "stabilizing braces" or simply a buffer tube) there is no specific length. That said, there is a legal battle going on right now about rifles with braces. ATF and of course Biden administration wants anything under 16.5" to be classified as a SBR (short barrelled rifle) which requires a tax stamp (see here). Trump also told ATF to do it and despite the fact that ATF had previously ruled they were not SBR, millions were sold. A judge last month reversed the ATF ruling and for now all these weapons are in limbo. Trust no one you don't know personally for a long time.

    The ruling as of now......for the 410 I'm gonna build.........is 26" overall from tip to end of buffer tube. It use to be the end of the brace. Barrel length doesn't matter. It's not a pistol, rifle, or shotgun......It's just considered a firearm :D

    @Brian422 @pdaddy @ty.s07 and anyone else that was following the convo.

    I was mistaken. That 410 isn't considered an AOW. It's just a firearm......not a pistol, rifle, or shotgun. It just has to have an overall length of 26" from tip of barrel to end of buffer tube(use to be the brace, but that has changed)

    Quote from article I linked - “Any other weapons” (AOWs) are subject to the registration and fee requirements of the NFA. Weapons regulated by the NFA include “a weapon made from a rifle if such weapon as modified has an overall length of less than 26 inches or a barrel or barrels of less than 16 inches in length,” according to the ATF.
    Barrel length does make a difference.

    The key phrase is “made from a rifle”. When @gixxerphil goes to pick up his lower, he’ll check the box on the form as “other”, not pistol or rifle bc it’s neither of those yet. It starts life out as a “firearm” and therefore legal as long as it maintains 26in overall length. It falls under the same category as a mossberg shockwave


    It's not a rifle, as it has no stock and has a smoothbore barrel.

    Not a pistol, as it has a smoothbore barrel.

    Not a shotgun, as it never had a shoulder stock.

    Not an AOW as it is over 26" and is therefore not concealable.

    Not an SBS as again, no shoulder stock

    wow the ATF is fun! Lol

    This is from a virgin lower. It's never been a pistol or rifle. The only length for the 410 is 26" OAL. I was wrong when I said it was an AOW. It's not classified as that per the ATF.



    1. As of February 2021, "Incidental and Sporadic" shouldering of a pistol brace is legal. Regardless of the fact that I'm not shouldering the brace at any time in this video, I guess I have to mention this.
    2. This isn't an SBR. It's not a rifled barrel, nor does it have a stock, so it would never be an SBR.
    3. This isn't an AOW or an SBS. While it has a smoothbore barrel which is shorter than 18", it does not have a shoulder stock (meaning it can't be a shotgun of any type), and maintains an OAL (from bare muzzle to bare buffer tube) exceeding 26", putting it in the same legal classification as the Mossberg Shockwave and other similar designs.

    I’m worried about getting pulled over by Joe Fudd the cop who knows nothing about these laws and then I have to wait a day or two in a cell until someone can explain to him why it’s legal. It’s crazy lol

    I've never had a vertical grip. I have only used the trinity force grip. I suppose it could be used as a vertical grip if you have small hands or don't want your pinky touching it :D I wrap my hand around the rail and place my pinky towards the trigger using the indent as a stopper.
