    I live in Beaverton and work in the Pearl, so I am able to avoid the problem areas.

    I don't think any of the dealers around here would be any better than what you're working with, although I have only been to the dealer for 1 Toyota care service. Hope they figure it out for you.

    Nah it doesn’t need to be a significant problem at all, just three visits to the shop in most states. It’s also not hard to enforce at all and does not involve the dealership whatsoever. It does however, take a long time to settle because the manufacturer will try and wear out your patience by moving extremely slow and dragging out your case so that you just give up. On top of that, manufacturers will almost never do replacement vehicles or buybacks and instead almost always opt for “cash and keep” settlements. This is to protect their brand’s reputation (they don’t consider it a lemon in the eyes of a law w/cash and keep) and also to avoid having to determine what to do with a lemon that was given back to them.

    Not the full amount. You and/or your lawyer negotiate an amount with the manufacturer. Kinda nice because then the vehicle is literally not considered a lemon so it can be resold, clean title.

    Based on what I’ve read, the settlements are typically not small amounts either. Mostly common for people to get checks into the 5 figure amounts.

    No, that’s only if it is replaced or repurchased. The release contract that is signed when you accept a cash and keep settlement makes it very clear that the manufacturer is not admitting fault or admitting that it is a lemon. They use very concise language that states the money being offered is done so in the spirit of negotiation to settle. Dealerships and everyone else on the planet aside from you, your lawyer, and the manufacturers lawyers will never know that it is a lemon (because legally it is not).

    My understanding was that if you are selling a lemon you are legally required to disclose that information. But honestly I don’t know enough about this crap to know one way or another.

    Recent experience w/lemon law...

    I bought a new '17 F250 Lariat (diesel) and immediately had problems. Air ducts, headlights, power seats, engine block heater, it was always something. Then, the audio head quit and I had it in 3 times to get it fixed. During that, I started experiencing "death wobble" at highway speeds if I hit a bump. 3 attempts with dealer and still no solution. I contacted a lawyer who specialized in lemonade. 3 trips with no resolution and still under OEM warranty qualified. However, each state is different and Colorado only provided lemon protection for 1 year (thanks :jerkoff:) but fortunately, there is a federal statute that covers lemons for 3 years as long as it is still under OEM warranty. So, we sued Ford (not the dealer) for both items. Took about 3-4 months and we got $9K from Ford after signing some waivers, etc.

    With a still clean title, we took that piece of shit DIRECTLY to the Toyota dealer and traded for my OR DCLB. This is what happens when you pay $60K for a $20K truck! Anyway, Toyota gave me $52K on trade in so, that worked out.:burnrubber::thumbsup:

    Know the law in your state. Take those bastards to task for not giving a shit about build quality. If you have just cause...Sue! Sue! Sue!:cheers:

    Yes but you are misunderstanding a little bit. There are three types of settlements when it comes to lemon law.

    - Direct Replacement: The manufacturer takes your car back and gives you a new one of equal or greater value
    - Buyback: The manufacturer gives you every dime that you paid back and you return the car
    - Cash and Keep: The manufacturer pays you and agreed upon settlement amount and you keep the car

    In the eyes of the law, the first two legally make your vehicle a lemon. In the third option, your vehicle is never considered a lemon.

    The reason the manufacturers typically go with the third option (cash and keep) is because with the first two, as you mentioned, the manufacturer legally has to disclose that the vehicle is a lemon if they try to resell it. Of course nobody is going to buy a lemon, or at least not for very much, so with the first two options they are left either selling the lemon for very little money (probably losing more than if they just paid you a settlement like w/ option three) or deciding something else to do with the vehicle.

    You cannot disclose that something is a lemon if it was never actually considered a lemon. SO if you settle with the third option, your vehicle remains a clean title vehicle and you can sell as you wish without disclosing anything. The third option basically the manufacturer saying in more "official contract" terms, "we are not admitting that what you claim to be wrong with this vehicle is actually wrong but we don't want to eat the cost of going to court and probably losing, so please take this money and sign off that you will never bother us w/ this vehicle again."

    EXACTLY! Just had the same thing with my 2020 Tacoma TRD OR DCSB except my settlement was a chunk more and I traded my 2020 Tacoma in for the EXACT price I paid for it in 2020 (sorry not trying to out-do you on the lemon earnings here :D).

    Anyway, I am currently waiting now on my replacement 2021 TRD OR DCSB in Army Green. Should be here today or tomorrow morning! :amen: Really speaks volumes about a brand's reputation for quality when I went through soooo much shit with Toyota through this lemon law process and I literally buy the exact same truck again.
