I recently sold a pair of BHLM to a fellow TW member. Before I sold it to him I made sure and gave him an accurate decription. I packaged the light in two separate boxes and made all the effort to protect the lights inside during shipping. I used US postal and purchased insurance. Now I get an email not from the Buyer but from his mom demanding a refund and she opened a case in Paypal accusing me of selling him a broken light. I took pictures the same night I posted the item for sale and clearly you can see the item was not broken. I'm not even sure what part broke. All the mom said on her email was when they opened the box one of the lights is broken. Not to mention they recieved the lights back on 1/15 and I recieved the email yesterday. What should I do? Am I responsible to issue them a refund?

Get pictures of the broken product, if it really is broken find out why they waited so long to contact you. Then if everything seems legit contact USPS and make an argument about it being broken and what they can do about the matter. Try to be as friendly as possible with all parties involved. Also keep record of everything as you go.

Settle it like adults.. None of our business.... at least honor any contract you entered into with paypal; I am not familiar with paypal but I am sure there are some general guidelines.. If not.. whatever.. neither of you thought to insure it, sounds like its both of your problems.

Contact the Post Office where you mailed it, give them the insurance # off the receipt you kept when you mailed it, and ask them what you need to do to collect on the insurance you purchased. Find out if they need proof of the damaged product, as in photos from the receiver. Request that from the guy you sold it to (not his mom). I don't know what she is doing jumping in on this. Sorta sounds like mom is pissed that junior bought these, and has concocted a story to get junior's money back. If indeed the light is broken, have them provide proof. Also contact Paypal and find out what your liability is through them if any, especially in light of your photos selling the product which show them not to be broken.

hmm not sure but it gave me the idea of taking pics of everything as i sealed and boxed parts before i ship them out, just incase something like this happens, but if you claim to UPS that the parts were broken during the shipping process they can probably do something about it as long as didnt send broken lights(which im positive you didnt, nobody on TW is like this..for the most part) and if the buyer agrees to just wait it out and stay cool everything will be alright, keep us posted though!

id like to see the damage that the mother is questioning. Is it the light not working properly or is it physically damaged? It is pretty irresponsible for the mother to go directly to paypal first without even trying to resolve the issue with you.

first ask for pictures of the damage and the packaging...then submit your pictures and info to paypal..lastly contact the postal office and ask them what is the time table for collecting on damage...it's not your fault the buyer waited however long to email you

lastly, LOL at this kid's mom handling his mod purchases

the kid may have tried to install them and broke them while trying then told his mom they came broke...that may explain the long delay. get pics of the damage for sure.

What he said. If the item was broken in shipping and you purchased insurance, then that it is what it is for. The buyer needs to provide more information so that it can be documented as to what happened. Then contact USPS and file the claim with your supporting documentation (including photos). Likely, USPS will want the items when they pay off the claim. Usually the way that works is that you will refund the buyer, and USPS will pay the claim to you since you were the party that insured the item. The only catch you might have is if USPS says the items were insufficiently packaged. So I would:

    1. Contact buyer and let them know you want to make it right, but that your need photos and description of what is broken to file an insurance claim. Find out if the box appears damaged in any way as this will help your claim tremendously. If the box is not damaged, that is an indication that the problem was with the way the item was packaged.

    2. Present the information you receive to the post office where you mailed the item for claim.

    3. If USPS pays your claim, refund the buyer's money.

    4. If USPS determines that the problem was with your packaging, refund the buyer their money and have them ship the item back to you.(Yes it rots to have to give the money back, but whether it was really your packaging or not, a good reputation is worth a lot more in the long run than a few dollars).

The Postal Service Insurance is the riding a slow train to China while watching the English Patient. I can guarantee if they pay a claim it won't be less than 6 months. Since the buyer did not contact you timely it is not likely that they were damaged during shipping. It sounds like the son should not have made the purchase or like the other person stated may have damaged them during installation. I had to deal with a buyer that was not honest on Ebay and disputed with Paypal. Paypal ruled in their favor, (all lies), and then they did not follow the rules and respond in time, so I did not have to send a refund. Then the guy emails me and says that he was dishonest, he lost his job and should not have made the purchase. I have found that Paypal will rule in the buyer's favor in most cases. Request photo evidence of the damage and why the delay in contact. You can refund and file a claim with USPS but be prepared to wait.
