    A few years ago when I was living on Long Island, NY, in early spring, just at the end of the snow melt, I hit a monster pothole in my VW Passat. It was night, an unlighted road out towards the eastern end of the island (very rural). It literally shattered the wheel (broke it completely in half like a bagel being sliced), blew the tire, and buggered the wheel bearing. When I bought the car a couple years prior to that (brand new, from a VW dealer on Long Island), they strongly recommended I also buy a wheel/tire insurance policy, because they said it is extremely common there, for people to park too close to the curb and scratch the shit out of their rims/tires, because in NY, the curbs are straight up/down, whereas in other states the curbs are gently curved away from the street, so this rarely happens elsewhere. I bought the policy.

    So, after I had the car towed back to the [same] dealership, they told me that due to the amount of damage, ,they would need to call the [tire/wheel policy company] adjuster to come out and inspect the damage before they would replace. Made sense to me, no problem. Got a call back a couple days later..... Adjuster came out, looked it over, and said "this is obviously a manufacturer's defect, claim denied!". I even had the dealership GM call them and argue... didn't work. So that fcuking pothole ended up costing me $1300 for new wheel bearing, new rim, new tire, labor. :spending:



    To add a little more, the dealership GM (who also sold me the car, really cool guy) explained that NY has laws that protect drivers from pothole damage under certain circumstances, and he suggested I file a claim with the Town where the pothole was. The State / local municipalities have a certain grace period after the snow melts, to repair all potholes, otherwise they are liable for any vehicle damage from potholes they didn't repair. This arises because all the roads have to be plowed all winter, whcih damages the road surface, causing potholes. I found the forms on the Town web site, filed my claim. Several weeks later, they responded back "That road is a State Route, so even though it is within our Town limits, we don't have jurisdiction, go file a claim with the State of NY. Claim Denied!" :annoyed:Ok, so I file a claim with the State. Several weeks later, they responded "The State of New York is only liable for vehicle damage between April 1st and November 1st each year. Claim Denied!". Date I hit the pothole........ March 17th (St. Patrick's Day). :annoyed::annoyed::annoyed:
