    shit out of luck. There are no Colorado laws in place for this sort of thing. He's not responsible for my repairs and he doesn't have to trim the tree. He's absolutely negligent, but since his house is unaffected, he don't give a shit.

    Many many times. I think this one is permanent. No clue. Mods don't talk to me. Guess they don't like dark humor or someone got their panties in a wad because they couldn't see something they didn't like and move on.

    Here's what you CAN do to protect yourself in a future event. You might bounce this of your homeowners carrier. They would likely enjoy the same protection and "might" pay for the set up. You'd hire a Certified Arborist to evaluate the tree, up close and personal if that homeowner allows, otherwise from your property and public space, including a drone video. That report states the obvious as well as mitigation measures and is copied to that homeowner AND his homeowners carrier. If shit hits the fan, you have essentially proven negligence on his part. The likelihood is his carrier will threaten to drop his coverage unless he mitigates the proven hazard. It will motivate him to do something or if he chooses to not, you have him by the balls as a civil matter. Shouldn't cost more than a few hundred bucks to get a report done.

    I have been in these identical situations numerous times as an expert witness for private insurance as well as for municipalities. I've never been part of a lost a case. Several on the municipal level have included criminal convictions. Whack a tree....go to jail! :rofl:
